قانون رقم (25) لسنة 2007 بإنشاء وتنظيم معهد أبوظبي للتعليم
والتدريب المهني
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي،
بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته، وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني وتعديلاته، وعلى القانون رقم (24) لسنة 2005 بإنشاء مجلس أبو ظبي للتعليم، وعلى القانون الاتحادي رقم (4) لسنة 1992 في شأن إنشاء وتنظيم وزارة التعليم العالي والبحث العلمي، وبناءً على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه، أصدرنا القانون الآتي:
الباب الأول: في التعاريف
مادة (1)
في تطبيق أحكام هذا القانون يقصد بالكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يقض سياق النص بخلاف ذلك:
الدولة: دولة الإمارات العربية المتحدة.
الإمارة: إمارة أبو ظبي.
مجلس أبوظبي للتعليم: المجلس المنشأ بالقانون رقم (24) لسنة 2005.
المعهد: معهد أبو ظبي للتعليم والتدريب المهني.
المجلس: مجلس إدارة المعهد.
الباب الثاني: في إنشاء المعهد ومقره وأهدافه
مادة (2)
ينشأ معهد في الإمارة يسمى (معهد أبو ظبي للتعليم والتدريب المهني) يكون له الشخصية الاعتبارية المستقلة، ويتمتع بالاستقلال المالي والإداري في جميع شؤونه، وبالأهلية القانونية الكاملة، ويكون تابعًا لمجلس أبوظبي للتعليم.
مادة (3)
مقر المعهد الرئيسي مدينة أبوظبي، ويجوز بقرار من مجلس أبوظبي للتعليم بناءً على اقتراح من المجلس فتح فروع له داخل الإمارة أو خارجها.
مادة (4)
يهدف المعهد إلى الإسهام في تعزيز فرص التعليم والتدريب، وتنوعها، في إطار النظام القانوني المطبق في الدولة. ويمنح المعهد الشهادات المهنية وفقًا للأنظمة والمؤهلات التعليمية المطبقة في الدولة.
الباب الثالث: في التنظيم الإداري والأكاديمي للمعهد
مادة (5)
يتولى إدارة كافة شؤون المعهد مجلس إدارة مكون من سبعة أعضاء على الأقل بمن فيهم الرئيس ونائبه، يمثلون القطاعات الاقتصادية الرئيسية في الإمارة، يصدر بتعيينهم وتحديد مخصصاتهم قرار من رئيس المجلس التنفيذي، بناءً على اقتراح مجلس أبوظبي للتعليم.
- مدة المجلس ثلاث سنوات قابلة للتجديد لمدة أو لمدد أخرى مماثلة.
- يعين المجلس مقررًا له.
مادة (6)
تحدد اللوائح إجراءات اجتماعات المجلس، وكيفية التصويت على قراراته.
مادة (7)
هذا النص وفقًا لآخر تعديل بموجب القانون رقم 11 لسنة 2009 - (للاطلاع على النص الأصلي)
المجلس هو السلطة المختصة بشؤون المعهد، وتصريف أموره، وله بصفة خاصة ما يلي:
- اعتماد السياسة العامة للتعليم والتدريب في المعهد بما يتفق مع الأهداف التي أنشئ من أجلها.
- اعتماد البرامج الدراسية ومدتها.
- إصدار التقويم الدراسي.
- منح الشهادات وفقًا للأنظمة المتبعة.
- إصدار اللوائح الإدارية والمالية والهيكل التنظيمي للمعهد ونظم التوظيف في المعهد.
- تحديد الرسوم بالتنسيق مع مجلس أبوظبي للتعليم.
- تفويض بعض اختصاصاته إلى أي من أعضاء المجلس أو المدير العام.
- أية اختصاصات أخرى منصوص عليها في هذا القانون، أو يعهد بها إلى المجلس بقرار من مجلس أبوظبي للتعليم.
- يجوز تفويض كل أو بعض تلك الاختصاصات بقرار من رئيس المجلس التنفيذي.
مادة (8)
يكون للمعهد مدير عام يصدر بتعيينه قرار من مجلس أبو ظبي للتعليم، يحدد فيه درجته ومخصصاته ومكافآته المالية، وله على الأخص ما يلي:
- تسيير الأعمال المعتادة للمعهد.
- تمثيل المعهد أمام القضاء والغير.
- وضع قرارات وتوصيات المجلس موضع التنفيذ.
- إعداد وعرض الميزانية والحساب الختامي على المجلس.
- إعداد مشروعات اللوائح الداخلية والأنظمة المتعلقة بالشؤون المالية والفنية والموارد البشرية والهيكل التنظيمي للمعهد.
- إصدار القرارات المتعلقة بشؤون موظفي المعهد في حدود اللوائح والأنظمة النافذة.
- رفع البرامج والخطط الأكاديمية والإدارية التي تساهم في تنفيذ أهداف المعهد إلى المجلس.
- إعداد تقارير دورية عن سير العمل ورفعها إلى المجلس.
- الاتصال والتنسيق بين المعهد وكافة الجهات ذات العلاقة بأعماله واختصاصاته.
- تفويض بعض اختصاصاته إلى بعض كبار موظفي المعهد.
- ما يكلف به من قبل المجلس.
مادة (9)
يكون للمعهد إدارة للشؤون الأكاديمية برئاسة المدير العام، وتتكون من عدد من الأساتذة يصدر بتعيينهم قرار من المجلس، وتختص بالآتي:
- اقتراح المناهج الدراسية ورفع التوصيات للمجلس.
- الترشيح لوظائف أعضاء هيئة التدريس ورفع المقترحات إلى المجلس.
- إعداد اللوائح الداخلية للمعهد بأقسامه المختلفة، ورفعها إلى المجلس للاعتماد.
- اقتراح سياسة تطوير الأنشطة التعليمية والتدريبية ورفعها إلى المجلس للاعتماد.
- أية مهام أخرى أكاديمية تكلف بها المجلس.
مادة (10)
يكون للمعهد إدارة للشؤون الإدارية، تتكون من عدد من الموظفين برئاسة المدير العام، يصدر بتعيينهم قرار من المجلس، وتختص بالآتي:
- جميع المسائل المالية والإدارية المتعلقة بموظفي ومستخدمي المعهد.
- شغل الوظائف الإدارية من غير أعضاء هيئة التدريس، وفقاً للوائح المطبقة في المعهد.
- أية مهام أخرى مالية وإدارية تكلف بها من المجلس.
الباب الرابع: في أعضاء هيئة التدريس
مادة (11)
يتم اختيار أعضاء هيئة التدريس من ذوي الخبرة في التعليم والتدريب المهني، وفقاً للخطة الدراسية المعتمدة في المعهد، وتحدد اللائحة التنفيذية قواعد وشروط ذلك.
الباب الخامس: في البرامج التعليمية
مادة (12)
- يقدم المعهد برامج في مجال التعليم والتدريب المهني لنيل شهادة الدبلوم، وشهادة الكفاءة المهنية في تخصصات متعددة وفقًا لاحتياجات التوظيف في القطاعين العام والخاص في الدولة.
- يجوز للمعهد تقديم برامج تدريبية مصممة وفق احتياجات بعض المؤسسات، بناءً على موافقة مسبقة من المجلس ومجلس أبوظبي للتعليم.
- يكون إنشاء الأقسام والبرامج والغاؤها بقرار من المجلس، بالتنسيق مع مجلس أبوظبي للتعليم.
مادة (13)
تحدد اللائحة التنفيذية مدة الدراسة في العام الأكاديمي بصفة عامة، ومدة الفصل الدراسي، وكيفية تقييم الدارسين في كل فصل وفي كل مساق من المساقات المسجل فيها الدارس، وعدد الساعات المعتمدة، وإجراءات البت في طلبات الالتحاق بالمعهد وحفظ الأمن والنظام فيه.
الباب السادس: في الشؤون المالية
مادة (14)
يكون للمعهد ميزانية سنوية معتمدة من المجلس، وتتكون موارد هذه الميزانية من الآتي:
- الاعتمادات السنوية التي تخصص من ميزانية الإمارة، بناءً على توصية مجلس أبوظبي للتعليم بالتنسيق مع المجلس.
- دخل أموال المعهد الثابتة والمنقولة.
- أية موارد مالية أخرى يقررها مجلس أبوظبي للتعليم بناءً على اقتراح المجلس.
مادة (15)
يتم الصرف من ميزانية المعهد وفقًا للنظام المالي المعتمد من المجلس، بالتنسيق مع مجلس أبوظبي للتعليم.
مادة (16)
يعين مجلس أبوظبي للتعليم مدققًا قانونيًا أو أكثر من المدققين المعتمدين لمراجعة وتدقيق كافة حسابات المعهد، وله كافة الصلاحيات اللازمة للاطلاع على أي مستند لازم لأداء عمله وفقًا للقانون، ويرفع تقريرًا بنتيجة عمله إلى مجلس أبوظبي للتعليم، ويبلغ صورة من هذا التقرير إلى المجلس.
مادة (17)
يخضع موظفو ومستخدمو المعهد لأحكام قوانين ونظم الخدمة المدنية المعمول بها في الإمارة إلى حين صدور اللوائح الإدارية والمالية للمعهد، وفيما لم يرد بشأنه نص خاص بها.
يسري في شأن المواطنين أحكام قانون معاشات ومكافآت التقاعد المدنية المعمول به في إمارة أبو ظبي.
مادة (18)
تصدر اللائحة التنفيذية لهذا القانون بقرار من رئيس المجلس التنفيذي، بناءً على اقتراح مجلس أبوظبي للتعليم.
مادة (19)
ينفذ هذا القانون من تاريخ صدوره، وينشر في الجريدة الرسمية.

Law No. (25) of 2007 Concerning the Establishment and Regulation of the Abu Dhabi Vocational Education
and Training Institute
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi,
Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments, and Law No. (2) of 1971 concerning the National Consultative Council and its amendments, and Law No. (24) of 2005 on the Establishment of the Abu Dhabi Education Council, and Federal Law No. (4) of 1992 on the Establishment and Regulation of the Ministry of Higher Education and Scientific Research, and based on the proposal submitted to the Executive Council and its approval, We have issued the following Law:
Chapter One: Definitions
Article (1)
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each of them, unless the context otherwise requires:
The State: The United Arab Emirates.
The Emirate: The Emirate of Abu Dhabi.
Abu Dhabi Education Council: The Council established by Law No. (24) of 2005.
The Institute: Abu Dhabi Vocational Education and Training Institute.
The Board: The Board of Directors of the Institute.
Chapter Two: Establishment, Headquarters, and Objectives of the Institute
Article (2)
An institute shall be established in the Emirate named the (Abu Dhabi Vocational Education and Training Institute), which shall have an independent legal personality, enjoy financial and administrative independence in all its affairs, and have full legal capacity. It shall be affiliated with the Abu Dhabi Education Council.
Article (3)
The main headquarters of the Institute shall be in the city of Abu Dhabi, and by a decision of the Abu Dhabi Education Council, upon the proposal of the Board, branches may be opened within or outside the Emirate.
Article (4)
The Institute aims to contribute to enhancing and diversifying education and training opportunities within the legal framework applicable in the State. The Institute shall grant professional certificates in accordance with the systems and educational qualifications applicable in the State.
Chapter Three: Administrative and Academic Organization of the Institute
Article (5)
The management of all affairs of the Institute shall be undertaken by a Board of Directors composed of at least seven members, including the Chairman and Vice-Chairman, representing the main economic sectors in the Emirate. A decision for their appointment and the determination of their allowances shall be issued by the Chairman of the Executive Council, based on the proposal of the Abu Dhabi Education Council.
- The term of the Board is three years, renewable for one or more similar terms.
- The Board shall appoint a rapporteur.
Article (6)
The regulations shall specify the procedures for the Board's meetings and the method of voting on its decisions.
Article (7)

The Board is the competent authority for the affairs of the Institute and the management of its matters, and it shall have, in particular, the following:
- Approving the general policy for education and training at the Institute in line with the objectives for which it was established.
- Approving academic programs and their duration.
- Issuing the academic calendar.
- Granting certificates in accordance with the followed regulations.
- Issuing administrative and financial regulations, the organizational structure of the Institute, and employment systems at the Institute.
- Determining fees in coordination with the Abu Dhabi Education Council.
- Delegating some of its powers to any of the Board members or the Director-General.
- Any other powers stipulated in this Law, or entrusted to the Board by a decision of the Abu Dhabi Education Council.
- All or some of these powers may be delegated by a decision of the Chairman of the Executive Council.
Article (8)
The Institute shall have a Director-General appointed by a decision of the Abu Dhabi Education Council, which shall specify his grade, allowances, and financial rewards. He shall have, in particular, the following:
- Managing the routine business of the Institute.
- Representing the Institute before the judiciary and third parties.
- Implementing the decisions and recommendations of the Board.
- Preparing and presenting the budget and final account to the Board.
- Preparing draft internal regulations and systems related to financial, technical, human resources, and the organizational structure of the Institute.
- Issuing decisions related to the affairs of the Institute's employees within the limits of the applicable regulations and systems.
- Submitting academic and administrative programs and plans that contribute to achieving the Institute's objectives to the Board.
- Preparing periodic reports on the progress of work and submitting them to the Board.
- Liaising and coordinating between the Institute and all entities related to its work and competencies.
- Delegating some of his powers to some of the senior employees of the Institute.
- Any other tasks assigned by the Board.
Article (9)
The Institute shall have an Academic Affairs Department headed by the Director-General, consisting of a number of professors appointed by a decision of the Board. It shall be responsible for the following:
- Proposing curricula and submitting recommendations to the Board.
- Nominating candidates for faculty positions and submitting proposals to the Board.
- Preparing the internal regulations for the Institute's various departments and submitting them to the Board for approval.
- Proposing a policy for the development of educational and training activities and submitting it to the Board for approval.
- Any other academic tasks assigned by the Board.
Article (10)
The Institute shall have an Administrative Affairs Department, consisting of a number of employees headed by the Director-General, appointed by a decision of the Board. It shall be responsible for the following:
- All financial and administrative matters related to the employees and staff of the Institute.
- Filling administrative positions other than faculty members, in accordance with the regulations applicable at the Institute.
- Any other financial and administrative tasks assigned by the Board.
Chapter Four: Faculty Members
Article (11)
Faculty members shall be selected from those with experience in vocational education and training, in accordance with the approved academic plan of the Institute. The executive regulations shall specify the rules and conditions for this.
Chapter Five: Educational Programs
Article (12)
- The Institute shall offer programs in the field of vocational education and training to obtain a diploma and a vocational proficiency certificate in various specializations according to the employment needs in the public and private sectors in the State.
- The Institute may offer training programs designed according to the needs of certain institutions, based on prior approval from the Board and the Abu Dhabi Education Council.
- The establishment and cancellation of departments and programs shall be by a decision of the Board, in coordination with the Abu Dhabi Education Council.
Article (13)
The executive regulations shall determine the duration of study in the academic year in general, the duration of the semester, the method of evaluating students in each semester and in each course in which the student is enrolled, the number of credit hours, and the procedures for deciding on applications for admission to the Institute and maintaining security and order therein.
Chapter Six: Financial Affairs
Article (14)
The Institute shall have an annual budget approved by the Board, and the resources of this budget shall consist of the following:
- The annual appropriations allocated from the Emirate's budget, based on the recommendation of the Abu Dhabi Education Council in coordination with the Board.
- Income from the Institute's fixed and movable assets.
- Any other financial resources decided by the Abu Dhabi Education Council based on the proposal of the Board.
Article (15)
Expenditure from the Institute's budget shall be made in accordance with the financial system approved by the Board, in coordination with the Abu Dhabi Education Council.
Article (16)
The Abu Dhabi Education Council shall appoint one or more certified legal auditors to review and audit all accounts of the Institute. The auditor(s) shall have all necessary powers to access any document required for the performance of their work in accordance with the law, and shall submit a report on the results of their work to the Abu Dhabi Education Council, and a copy of this report shall be communicated to the Board.
Article (17)
The employees and staff of the Institute shall be subject to the provisions of the civil service laws and regulations applicable in the Emirate until the issuance of the Institute's administrative and financial regulations, and in matters for which no special provision is made therein.
The provisions of the civil service pensions and retirement benefits law applicable in the Emirate of Abu Dhabi shall apply to citizens.
Article (18)
The executive regulations of this Law shall be issued by a decision of the Chairman of the Executive Council, based on the proposal of the Abu Dhabi Education Council.
Article (19)
This Law shall be effective from the date of its issuance and shall be published in the Official Gazette.
