Resolution No. (20) of 2023 Regarding the Organizing Regulation for Scholarships and Study Leaves in the Emirate of Abu Dhabi

قرار رقم (20) لسنة 2023 بشأن اللائحة التنظيمية للبعثات والإجازات الدراسية في إمارة أبو ظبي

رئيس دائرة التعليم والمعرفة

بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته.
وعلى القانون رقم (6) لسنة 2016 بشأن الموارد البشرية في إمارة أبو ظبي وتعديلاته.
وعلى القانون رقم (9) لسنة 2018 بشأن إنشاء دائرة التعليم والمعرفة.
وعلى القانون رقم (15) لسنة 2018 بشأن إنشاء أكاديمية أبوظبي الحكومية.
وعلى قرار رئيس المجلس التنفيذي رقم (24) لسنة 2018 بشأن اختصاصات إضافية لدائرة التعليم والمعرفة.
على (1) قرار المجلس التنفيذي رقم (219) لسنة 2021 بشأن إضافة مسار لخريجي كلية الطب ضمن برنامج بعثات أبو ظبي.
وعلى قرار المجلس التنفيذي رقم (123) لسنة 2022 بشأن برنامج البعثات الدراسية (خطوة).
وعلى قرار المجلس التنفيذي رقم (124) لسنة 2023 بشأن تنظيم وإدارة شؤون البعثات والإجازات والمنح الدراسية في إمارة أبو ظبي.
وعلى القرار الإداري رقم (351) لسنة 2017 بشأن اللائحة التنظيمية والمالية للبعثات والإجازات الدراسية في إمارة أبو ظبي.
وبناءً على ما عرض على المجلس التنفيذي وموافقة المجلس عليه،

تقرر ما يلي:

الفصل الأول

التعاريف والسريان

المادة (1)

تعاريف

في تطبيق أحكام هذه اللائحة يكون للكلمات والعبارات التالية المعاني المبينة أمام كل منها ما لم يدل سياق النص على خلاف ذلك:

الدولة	الإمارات العربية المتحدة.
الإمارة	إمارة أبو ظبي.
الحكومة	حكومة أبوظبي.
الدائرة	دائرة التعليم والمعرفة.
الأكاديمية	أكاديمية أبوظبي الحكومية.
اللجنة	لجنة البعثات الدراسية التي يصدر بتشكيلها وتنظيم عملها قرار من رئيس الدائرة.
الجهات الحكومية	الدوائر والهيئات والمؤسسات العامة والأجهزة والمراكز والمجالس والصناديق وأية جهة أخرى تتبع الحكومة.
جهات المتابعة	سفارات الدولة أو الملحقيات الثقافية في الخارج أو أية جهة تُخوّلها الدائرة متابعة المبتعثين.
المبتعث	الطالب المواطن، أو الموظف المواطن في إحدى الجهات الحكومية، الحاصل على بعثة دراسية وفقًا لأحكام هذه اللائحة.
التعليم العالي	المرحلة الدراسية التالية بعد حصول المواطن على شهادة الثانوية العامة أو ما يعادلها في إحدى المؤسسات التعليمية بغرض الحصول على درجة علمية أعلى (دبلوم / بكالوريوس / ماجستير / دكتوراة) وكذلك الدراسات الطبية وما يخصها من المجالات الفنية.
البعثة الدراسية	منحة من الحكومة للطلبة والموظفين المواطنين المرشحين للحصول على مؤهل في التعليم العالي داخل الإمارة أو خارجها وفق أحكام هذه اللائحة.
الإجازة الدراسية	الإجازة الممنوحة للموظفين المواطنين المرشحين من الجهات الحكومية في الإمارة للحصول على بعثة دراسية لإكمال الدراسة في إحدى المؤسسات التعليمية وفق أحكام هذه اللائحة والتشريعات السارية.
الانتظام الجزئي	الدراسة بنظام الفترات المتقطعة بما يتوافق مع شروط وزارة التربية والتعليم كحد أدنى لتواجد المبتعث في المؤسسة التعليمية داخل الإمارة أو خارجها.
الانتظام الكلي	الدراسة بالانتظام الكامل للمبتعث في المؤسسة التعليمية داخل الإمارة أو خارجها.
المؤسسة التعليمية	الجهات التعليمية العامة والخاصة سواء كانت داخل الإمارة أو خارجها، بما في ذلك جهات التعليم العالي والبحث العلمي المرخصة والمعتمدة من الجهات المعنية في الدولة والإمارة.
الكليات المجتمعية	كليات بديلة لإتمام أول سنتين كحد أدنى من درجة البكالوريوس للطلبة الدوليين.
الرسوم الدراسية	تكلفة التعليم العالي للمبتعث الملتحق بالمؤسسة التعليمية وفق أحكام هذه اللائحة.
ذوي الإعاقة	كل شخص مصاب بقصور، أو اختلال كلي، أو جزئي بشكل مستقر، أو مؤقت في قدراته الجسمية، أو الحسية، أو العقلية، أو التواصلية، أو التعليمية، أو النفسية إلى المدى الذي يقلل من إمكانية تلبية متطلباته العادية في ظروف أمثاله من غير ذوي الإعاقة.
المخصصات المالية	المبلغ الشهري المقرر للمبتعث بالإضافة للمكافآت والبدلات والمزايا الأخرى التي يحصل عليها، وذلك بحسب الفئات المشار إليها في الجدول (أ) المرفق بهذه اللائحة.
العائلة	الزوج أو الزوجة وإن تعددت، والأبناء الذين لم يكملوا سن الثامنة عشر للمبتعث.
المرافق	مرافق المبتعث من الدرجتين الأولى أو الثانية وفقًا للتشريعات السارية.
المرشد الأكاديمي	شخص مدرب ومؤهل لتوجيه الدعم اللازم للمبتعثين خلال مرحلة دراستهم لتحقيق أهدافهم الأكاديمية.
عقد الابتعاث	العقد المبرم بين الدائرة والمبتعث والذي يحدد التزامات وحقوق الطرفين.
برنامج خطوة	برنامج معني بالطلبة ذوي الأداء الأكاديمي المنخفض لإكمال تعليمهم العالي.

المادة (2)

سريان اللائحة

تسري أحكام هذه اللائحة على جميع المبتعثين بما فيهم الملتحقين أو المستمرين بالدراسة وقت صدور أحكام هذه اللائحة.
يُمنح المبتعثون قبل صدور هذه اللائحة ثلاثة فصول دراسية أو ما يعادلها، وذلك لتعديل وضعهم الأكاديمي وفق أحكام هذه اللائحة.
ستطبق تعديلات البدلات والمخصصات المالية للطلبة المبتعثون قبل صدور هذه اللائحة بعد عام أكاديمي واحد فقط وفقًا للجدول (أ) المرفق بهذه اللائحة.

الفصل الثاني

البعثات الدراسية للطلبة

المادة (3)

نطاق التطبيق

تُطبق أحكام هذا الفصل على:

الطالب الحاصل على شهادة الثانوية العامة أو ما يعادلها لإكمال تعليمه في إحدى المؤسسات التعليمية داخل الإمارة أو خارجها.
الطالب المنتظم في التعليم العالي الراغب في الحصول على بعثة دراسية لإكمال تعليمه الجامعي في إحدى المؤسسات التعليمية داخل الإمارة، أو خارجها.

المادة (4)

شروط البعثة الدراسية لدرجة البكالوريوس وما دونها

يشترط للحصول على بعثة دراسية لدرجة البكالوريوس وما دونها توفر الشروط والضوابط الآتية:

أن يكون من مواطني الدولة وألا يقل سنه عن سبعة عشر سنة ميلادية ولا يزيد على أربعة وعشرين سنة، ويثبت السن بشهادة ميلاد أو مستخرج رسمي أو بطاقة الهوية.
الحصول على نسبة لا تقل عن 80% في شهادة الثانوية العامة أو ما يعادلها.
الحصول على مؤهل علمي معتمد للشهادة الحالية من الجهات المختصة بالدولة تؤهله لإكمال تعليمه العالي، وأن يرفق السجل الدراسي الحديث في حالة كونه مستمرًا بالدراسة.
الحصول على قبول أكاديمي من إحدى المؤسسات التعليمية، ويعفى الحاصلون على قبول أكاديمي في أفضل 20 جامعة حسب التصنيف المعتمد لدى الدائرة من أي تقييمات أو اختبارات قبول تسري على غيرهم من الطلبة.
أن يجتاز المقابلة الشخصية والفحوصات الطبية والاختبارات التي تقررها اللجنة.
حُسن السيرة والسلوك ويثبت ذلك بشهادة معتمدة من الجهات المختصة بالدولة.
أن يكون التخصص الذي يرغب بدراسته من التخصصات المعتمدة من الدائرة.
الحصول على شهادة بيان وضع من الخدمة الوطنية والاحتياطية.
ألا يكون قد تم فصله سابقًا من أية مؤسسة تعليمية كإجراء تأديبي.
ألا يكون حاصلاً على بعثة دراسية من جهة أخرى.

المادة (5)

شروط البعثة الدراسية لبرنامج خطوة

يشترط للحصول على بعثة دراسية لبرنامج خطوة توفر الشروط والضوابط الآتية:

أن يكون من مواطني الدولة وألا يقل سنه عن سبعة عشر سنة ميلادية ويثبت السن بشهادة ميلاد أو مستخرج رسمي أو بطاقة الهوية.
الحصول على نسبة لا تقل عن 60% في شهادة الصف الحادي عشر وشهادة الثانوية العامة أو ما يعادلها، على أن تكون الشهادة الحالية معتمدة من الجهات المختصة بالدولة تؤهله لإكمال تعليمه العالي، وأن يرفق السجل الدراسي الحديث في حالة كونه مستمرًا بالدراسة في إحدى الكليات المجتمعية.
الحصول على قبول أكاديمي من إحدى الكليات المجتمعية والموصى بها من قبل الدائرة.
الحصول على معدل تراكمي (3.0) نقطة من أصل (4.0) نقطة بالنسبة للطالب الجامعي الملتحق بالدراسة في إحدى الكليات المجتمعية والموصى بها من قبل الدائرة، وأن يكون قد اجتاز ما لا يقل عن (12) ساعة دراسية في الفصل الدراسي معتمدة من الكلية المجتمعية الملتحق بها.
الحصول على معدل (3.0) في امتحان IELTS أو (31) في امتحان IBT TOEFL كحد أدنى.
أن يجتاز المقابلة الشخصية والفحوصات الطبية والاختبارات التي تقررها اللجنة.
حُسن السيرة والسلوك ويثبت ذلك بشهادة معتمدة من الجهات المختصة بالدولة.
أن يكون التخصص الذي يرغب بدراسته من التخصصات الموصى بها من قبل الدائرة.
الحصول على شهادة بيان وضع من الخدمة الوطنية، والاحتياطية.
ألا يكون قد تم فصله سابقًا من أية مؤسسة تعليمية كإجراء تأديبي.
ألا يكون حاصلاً على بعثة دراسية من جهة أخرى وألا يكون موظفًا على رأس عمله.

المادة (6)

شروط البعثة الدراسية للدراسات العليا

يشترط للحصول على بعثة دراسية للدراسات العليا توفر الشروط والضوابط الآتية:

أن يكون من مواطني الدولة.
الحصول على مؤهل علمي معتمد من الجهات المختصة بالدولة يؤهله لإكمال تعليمه العالي، وأن يرفق السجل الدراسي الحديث في حالة كونه مستمراً بالدراسة.
الحصول على قبول أكاديمي من إحدى المؤسسات التعليمية التي توصي بها الدائرة.
أن يجتاز المقابلة الشخصية والفحوصات الطبية والاختبارات التي تقررها اللجنة.
حسن السيرة والسلوك ويثبت ذلك بشهادة معتمدة من الجهات المختصة بالدولة.
أن يكون التخصص الذي يرغب في دراسته من التخصصات الموصى بها من قبل الدائرة.
الحصول على شهادة بيان وضع من الخدمة الوطنية والاحتياطية.
ألا يكون قد تم فصله سابقًا من أي مؤسسة تعليمية كإجراء تأديبي.
ألا يكون حاصلاً على بعثة دراسية من جهة أخرى.

المادة (7)

شروط البعثة الدراسية للطلبة من ذوي الإعاقة

تسري أحكام هذا الفصل على ذوي الإعاقة الراغبين بإكمال تعليمهم العالي لدى إحدى المؤسسات التعليمية، وتتم معاملتهم طبقًا للقواعد والشروط والضوابط الآتية:

أن يكون من مواطني الدولة.
أن يكون حاصلاً على شهادة الثانوية أو ما يعادلها.
الحصول على مؤهل علمي معتمد للشهادة الحالية من الجهات المختصة بالدولة يؤهله لإكمال تعليمه العالي، وأن يرفق السجل الدراسي الحديث في حالة كونه مستمرًا بالدراسة.
الحصول على قبول أكاديمي من إحدى المؤسسات التعليمية الموصى بها من الدائرة.
أن يجتاز المقابلة الشخصية والفحوصات الطبية والاختبارات التقييمية التي تقررها اللجنة.
حسن السيرة والسلوك ويثبت ذلك بشهادة معتمدة من الجهات المختصة بالدولة.
الحصول على شهادة بيان وضع من الخدمة الوطنية والاحتياطية.
ألا يكون قد تم فصله سابقًا من أية مؤسسة تعليمية كإجراء تأديبي.
ألا يكون حاصلاً على بعثة دراسية من جهة أخرى.

الفصل الثالث

الإجازات والبعثات الدراسية للموظفين المواطنين في الجهات الحكومية

المادة (8)

نطاق التطبيق

تطبق أحكام هذا الفصل على:

الموظف المرشح لإكمال تعليمه العالي، بالانتظام الجزئي أو الانتظام الكلي، لدى إحدى المؤسسات التعليمية والمستوفي لشروط وقواعد منح الإجازة الدراسية وفقًا للتشريعات السارية وطبقًا للقواعد والشروط الواردة في هذه اللائحة.
الموظف الحاصل على بعثة دراسية من خلال إحدى المؤسسات التعليمية أو أية جهة ابتعاث أخرى أو الذي يرغب بالدراسة على نفقته الخاصة، والمستوفي لشروط الإجازة الدراسية وفقًا للتشريعات السارية.

المادة (9)

- مع مراعاة عدم الإخلال بالقواعد والأحكام المنصوص عليها في القانون رقم (6) لسنة 2016 المشار إليه تعد الأكاديمية بالتنسيق مع الجهة الحكومية المعنية قائمة بالموظفين المواطنين المرشحين للابتعاث، والذين تمت الموافقة عليهم بعد التأكد من استيفائهم جميع الشروط وإجراء المقابلات اللازمة معهم، ورفعها إلى الدائرة لاعتمادها.

- تتولى الدائرة متابعة المبتعثين أكاديمياً ومالياً.

المادة (10)

تتولى دائرة الصحة ترشيح الموظف الطبيب بما يتناسب مع معايير اشتراطات القبول المتبعة لديها ورفع ذلك إلى الدائرة.

المادة (11)

شروط البعثة الدراسية لموظفي الجهات الحكومية

يشترط لمنح البعثة الدراسية للموظف ما يأتي:

استيفاء شروط منح الإجازة الدراسية المنصوص عليها في القانون رقم (6) لسنة 2016 المشار إليه.
الحصول على قبول أكاديمي من إحدى المؤسسات التعليمية التي توصي بها الدائرة موضحاً به الخطة الدراسية، متضمنة نوع الدراسة، والتخصص العلمي، ودرجة التعليم العالي ومدة الدراسة.
أن تكون الدراسة بالانتظام الكلي أو الجزئي في حرم المؤسسة التعليمية سواء داخل الإمارة أو خارجها وبما يتوافق مع شروط وزارة التربية والتعليم.
الحصول على شهادة بيان وضع من الخدمة الوطنية والاحتياطية.
أن يكون لائقاً صحياً.
حسن السيرة والسلوك ويثبت ذلك بشهادة معتمدة من الجهات المختصة بالدولة.
أن يكون حاصلاً على رسالة اعتماد التخصص والجامعة التي سيلتحق بها من وزارة التربية والتعليم، وذلك لمن يرغب في الدراسة خارج الدولة.
أن يكون حاصلاً على مؤهل علمي معتمد من الجهات المختصة بالدولة تؤهله لإكمال تعليمه الجامعي وأن يرفق السجل الدراسي الحديث في حالة كونه مستمراً بالدراسة.

الفصل الرابع

أحكام عامة

المادة (12)

المخصصات المالية للمبتعث

يصرف للطالب كل حسب حالته الاجتماعية المخصص المالي المقرر في البند ثانيًا من الجدول (أ) المرفق بهذه اللائحة.
يصرف للمبتعثين للدراسات الطبية وما يرتبط بها من المجالات الفنية بالإضافة للهيئة الإدارية والتدريسية والإدارية المساعدة كل حسب حالته الاجتماعية المخصص المالي المقرر في البند ثالثًا من الجدول (أ) المرفق بهذه اللائحة.
يصرف للطالب المبتعث للدراسة خارج الدولة من ذوي الإعاقة الذي لديه مرافق، بدل سكن بفئة المتزوج حسب مكان دراسته وفقًا للبند (ثانيًا) من الجدول (أ) المرفق بهذه اللائحة من المخصص المالي المقرر له، وذلك شريطة الإقامة الدائمة للمرافق خلال فترة الدراسة في بلد الابتعاث، وفي حالة مغادرة المرافق يستحق الطالب بدل السكن بفئة الأعزب من المخصص المالي وفقًا للجدول المشار إليه.
تصرف مكافأة لمبتعثي برنامج الدراسات العليا (غير الموظفين) في حال انتظامهم في الدراسة ضمن جامعات ذات تصنيف عال، بعد ظهور النتائج الرسمية في كل عام أكاديمي، وفقًا للبند (ثانيًا) من الجدول (أ-المكافآت) المشار إليه.

المادة (13)

دول الابتعاث والمؤسسات التعليمية والتخصصات الدراسية

- تتولى اللجنة اقتراح دول الابتعاث والمؤسسات التعليمية والتخصصات الدراسية الموصى بها للدراسة داخل الإمارة وخارجها، ورفعها لرئيس الدائرة للموافقة عليها.

- تنشر قائمة دول الابتعاث والمؤسسات التعليمة والتخصصات الدراسية المعتمدة عبر الموقع الإلكتروني للدائرة.

المادة (14)

مدة الابتعاث

- تُحدد مدة الابتعاث وفقًا للمدة المحددة من المؤسسة التعليمية.

- في حال وجود مبررات تعليمية أو متطلبات إضافية من قبل المؤسسة التعليمية (2) أو بسبب لا دخل للمبتعث به يجوز له أن يتقدم إلى اللجنة بطلب تمديد مدة الابتعاث.

- تتولى اللجنة دراسة طلب تمديد مدة الابتعاث ورفع توصياتها إلى رئيس الدائرة أو من يفوضه للموافقة على هذا الطلب من عدمه.

المادة (15)

دراسة اللغة

يجوز بقرار من الدائرة منح الطالب المبتعث سنة لدراسة اللغة في الخارج ويجوز تمديدها لمدة سنة أخرى بناءً على التقارير الواردة من جهات المتابعة أو المؤسسة التعليمية.

المادة (16)

قواعد الأداء الأكاديمي

يُقيم الأداء الأكاديمي لجميع المبتعثين من قبل الإدارة المختصة بشؤون الابتعاث في الدائرة ورفع توصياتها للجنة بالتنسيق مع الأكاديمية، وتتخذ في شأنهم الإجراءات المبينة في الجدول (ب) المرفق بهذه اللائحة وذلك تبعًا لنتائج التقييم.

المادة (17)

عقد الابتعاث

تصدر الدائرة نماذج عقود الابتعاث الخاصة بتنفيذ أحكام هذه اللائحة.

المادة (18)

التزامات المبتعث

يلتزم المبتعث بالواجبات الآتية:

التقيد بالأنظمة واللوائح المعمول بها لدى الدائرة وجهات المتابعة والمؤسسة التعليمية الملتحق بها، وما عليه من التزامات أخرى وفقًا لما ورد في عقد الابتعاث.
الانتظام في الدراسة والاهتمام بمتابعة الدروس وعدم التغيب عنها، وبذل أقصى جهد في الدراسة للحصول على شهادة التعليم العالي المبتعث إليه خلال المدة المحددة.
حسن السيرة والسلوك والحفاظ على سمعة الدولة، واحترام عاداتها وتقاليدها وقوانينها ورموزها وتمثيل الدولة بأفضل صورة في الخارج.
التقيد بالخطة الدراسية المعتمدة في المؤسسات التعليمية الملتحق بها وتزويد المرشد الأكاديمي بها في بداية البعثة الدراسية.
تنفيذ البرنامج التدريبي العملي حسب ما تقرره المؤسسة التعليمية.
عدم تغيير التخصص أو دراسة تخصص ثانوي أو مزدوج للمبتعث إلا بموافقة مسبقة من الدائرة.
عدم تغيير مقر الدراسة أو التعليم العالي المبتعث إليه إلا بموافقة مسبقة من الدائرة.
احترام كل قوانين دولة المبتعث إليها وبالأخص قوانين الهجرة والإقامة وألا يتدخل في شؤونها أو ممارسة أي أنشطة تخل بأنظمتها وسياستها وبما لا يتفق مع مصلحة الدولة.
سداد وتنفيذ جميع الالتزامات التعاقدية والمالية التي تقع على عاتقه وتبرئة ذمته لأية جهة قبل مغادرته الدولة المبتعث إليها.
إعداد جميع وثائق السفر المطلوبة ليكون جاهزاً للسفر في الوقت المحدد له.
الالتزام بالرد على استفسارات المرشد الأكاديمي والتجاوب معه وذلك عبر جميع وسائل الاتصال. ويترتب على مخالفة ذلك اتخاذ الإجراءات التأديبية في شأن المبتعث وفقًا للبند (الخامس) من الجدول (ج) المرفق بهذه اللائحة.
تحديث وتزويد جهات المتابعة والدائرة والمرشد الأكاديمي بشكل دوري ببيانات التواصل والسكن وبيانات الملف الشخصي والأكاديمي الصحيحة.
تزويد الدائرة أو المرشد الأكاديمي والاجتماعي بالسجل الدراسي في نهاية كل فصل أو عام دراسي.
وضع الدائرة كجهة اتصال أساسية فيما يتعلق بملفاته الأكاديمية.
الإقامة مع إحدى العائلات المضيفة في الدولة المبتعث إليها حال الابتعاث الدراسي لإحدى الكليات المجتمعية.
العمل لدى الجهة الحكومية أو جهة العمل المرشح للعمل لديها حسب اللوائح والنظم المعمول بها، وفي حالة مخالفة ذلك يحق للدائرة مطالبة المبتعث باسترداد جميع المخصصات المالية التي صرفت له أثناء دراسته.
تسليم الدائرة نسخة من البحث العلمي مع مراعاة حقوق الملكية الفكرية للمبتعث، وذلك لاستخدام نتائج بحثه في أغراض البحث العلمي حال الابتعاث لبرنامج الدراسات العليا.
عدم إعادة المواد الدراسية التي قد نجح بها سابقًا أو الانسحاب من أكثر من مادة دراسية سنوياً إلا بعد أخذ الموافقة المسبقة من الدائرة.
توقيع المبتعث أو من ينوب عنه قانوناً على نموذج عقد الابتعاث قبل الالتحاق بالبعثة الدراسية.
المشاركة في الورش التدريبية والأنشطة التي تنظمها أو توصي بها الدائرة.
إخطار الدائرة في حال حصوله على تدريب عملي أو وظيفة بعد التخرج.
عودة الموظف المبتعث فور إنهائه لمتطلبات تعليمه العالي وفق التقارير الواردة من المؤسسة التعليمية أو جهات المتابعة.

المادة (19)

البدلات والمخصصات

يصرف للمبتعثين خارج الدولة، باستثناء الموظف المبتعث للدراسة بالانتظام الجزئي، البدلات المبينة في البند أولاً من الجدول (أ) المرفق بهذه اللائحة.
يمنح الطالب المبتعث مخصصًا مالياً بحسب مكان دراسته والدرجة العلمية والحالة الاجتماعية وفقًا للبند ثانيًا من الجدول (أ) المرفق بهذه اللائحة، على أن يبدأ صرف المخصص المالي اعتباراً من بداية الشهر الذي يلتحق فيه الطالب بمقر دراسته، ويستمر صرفها لمدة شهرين للطالب المبتعث وشهر للملتحق ببرنامج خطوة بحد أقصى بعد إكماله لمتطلبات التعليم الجامعي، ولا تصرف المخصصات المالية والبدلات للمبتعث خارج الدولة، إلا بعد استكمال جميع إجراءات السفر بما في ذلك الحصول على التأشيرات اللازمة.
يصرف للمبتعثين في الكليات المجتمعية عند الحاجة في بداية البعثة مخصص بدل الإقامة في الفندق وذلك وفقًا لما ورد في الجدول (أ) المرفق بهذه اللائحة، وذلك بعد توصية اللجنة.
يستحق الطالب الذي أنهى المدة المقررة لدراسته في الكليات المجتمعية وذلك عند التحاقه بإحدى المؤسسات التعليمية الموصى بها من الدائرة لبرنامج البكالوريوس المبلغ الشهري المخصص لطلبة البكالوريوس المبتعثين خارج الدولة، وما دون ذلك يستمر مبتعث الكليات المجتمعية بالحصول على نفس المبلغ الشهري الذي حصل عليه من بداية ابتعاثه حتى نهاية البعثة الدراسية.
يحق للدائرة تخفيض أو إلغاء جميع أو بعض المخصصات المالية في حال انتظم الطالب بالدراسة عن بعد أو التواجد داخل الدولة.

المادة (20)

الرسوم الدراسية

تتحمل الدائرة الرسوم الدراسية للمبتعث اعتبارًا من الفصل الدراسي للعام الأكاديمي الذي صدر فيه قرار اللجنة وأي مصاريف أخرى لازمة لاستكمال متطلبات التعليم العالي وذلك بعد توصية جهات المتابعة أو المؤسسات التعليمية.
تتحمل الدائرة رسوم البرامج التحضيرية للاختبارات المقررة للدراسات العليا للمبتعثين ولمرة واحدة قابلة للتجديد لفترة أخرى خلال التعليم العالي بعد توصية جهات المتابعة وموافقة الدائرة.
تتحمل الدائرة الرسوم الدراسية - إن وجدت - لطلبة برنامج خطوة وذلك لإكمال دراستهم داخل الدولة للحصول على شهادة البكالوريوس في حال استدعاء الحالة الصحية للطالب بناءً على موافقة اللجنة الطبية بالإمارة.
يتم دفع الرسوم الدراسية للموظف المبتعث من تاريخ الموافقة على الابتعاث، كما يتم تغطية رسوم الفصل الدراسي الذي صدرت فيه الموافقة ولا يتم تغطية رسوم الفصول الدراسية السابقة بأثر رجعي.

المادة (21)

تذاكر السفر

يستحق المبتعثون للدراسة خارج الدولة بدلاً نقدياً لتذكرتي سفر (سنويًّا ) ذهابًا وإيابًا على الدرجة السياحية أو درجة رجال الأعمال حسب الحالة الصحية والمعتمدة من الجهات المختصة وذلك حسب أسعار التذاكر وقت السفر مع الناقل الوطني للدولة وإذا تعذر على الناقل الوطني وصوله إلى الوجهة المطلوبة فيتم ذلك من خلال الأسعار السارية من الشركات الأخرى وحسب الإجراءات المتبعة في الدائرة.
يستحق أفراد عائلة الموظف المبتعث خارج الدولة بالانتظام الكلي بدلاً نقدياً لتذكرتي سفر (سنوياً) ذهابًا وإيابًا على الدرجة السياحية حسب ما ورد في البند السابق.
يستحق المرافق بدلاً نقدياً لتذكرتي سفر عن السنة الأولى لالتحاق المبتعث بالبعثة الدراسية، ولا يحق المطالبة بها إذا لم تستنفد خلال مدة الـ (60) يومًا في السنة الأولى للبعثة الدراسية.
يستحق المبتعثون للدراسة خارج الدولة بدلاً نقدياً عن تذكرة سفر إضافية ذهابًا وإيابًا على الدرجة السياحية بعد موافقة الدائرة في الحالات الآتية:
- تحويل مقر الدراسة من دولة إلى أخرى.
- وفاة الزوج أو الزوجة أو أحد الأقارب من الدرجة الأولى.
- إصابة المبتعث خارج الدولة بمرض ما يتطلب منه العودة إلى الدولة بناءً على توصيات جهة طبية رسمية واعتماد جهات المتابعة وتحدد الدائرة الدرجة المناسبة لتذكرة الطيران حسب الحالة الصحية للمبتعث.
- الحاجة للرجوع للدولة بسبب حدوث أزمات أو كوارث في الدولة المبتعث إليها وفق ما تقرره الجهات المعنية.
في حالة الوفاة تتحمل الدائرة نفقات تجهيز ونقل جثمان المبتعث، أو أحد أفراد عائلته المرافقين له خارج الدولة، وفي الحالة الأولى يستحق المرافق للجثمان تذكرة سفر على الدرجة السياحية للعودة إلى الدولة.
لا يتم صرف بدلاً نقدياً لتذاكر السفر أو النفقات المنصوص عليها في هذه المادة لأي فرد من أفراد عائلة الموظف المبتعث أو لمرافق المبتعث الحاصل على بعثة أو إجازة دراسية من الدائرة أو من أية جهة أخرى.
يصرف للموظف المبتعث المنتظم بالدراسة داخل الدولة تذكرة طيران في حال تطلب تعليمه الجامعي وجوده خارج الدولة لأسباب يتم توضيحها ضمن الخطة الدراسية مؤيدة بتقرير صادر من المؤسسة التعليمية.
يشترط لاستحقاق بدل تذاكر السفر للمبتعثين وعائلاتهم وفقًا لحكم هذه المادة الإقامة الدائمة في بلد الابتعاث خلال مدة الدراسة.
يحق للدائرة إيقاف بدل تذاكر السفر في حال انتظم الطالب بالدراسة عن بعد وتواجده داخل الدولة.

المادة (22)

العلاج الطبي

باستثناء المبتعثين بالانتظام الجزئي، يستحق المبتعثون للدراسة خارج الدولة التأمين الصحي لهم ولعائلتهم حسب نظام العلاج المعمول به في جهات المتابعة ولا تدخل عمليات التجميل ومنها تقويم الأسنان والعدسات اللاصقة من ضمن العلاج المغطى.
في حال عدم تغطية التأمين الصحي لمصاريف العلاج، يُقدم المبتعث تقريرًا طبيًّا مفصلاً للدائرة يبين حالة المريض الصحية، على أن يكون معتمدًا من الجهة الطبية المختصة بالدولة.
يستحق الموظف المبتعث المنتظم بالدراسة داخل الدولة التأمين الطبي في حال تطلب تعليمه العالي التواجد خارج الدولة لأسباب يتم توضيحها ضمن الخطة الدراسية مؤيدة بتقرير صادر من المؤسسة التعليمية.

المادة (23)

تعليم العائلة

تتحمل الدائرة الرسوم الدراسية لعائلة الموظف المبتعث خارج الدولة للدراسة بالانتظام الكلي طوال فترة دراستهم وذلك على النحو الآتي:

تعليم اللغة للزوج أو الزوجة وإن تعددت لمدة ستة أشهر لدراسة اللغة خارج الدولة ويجوز أن تمدد لمدة ستة أشهر أخرى بناءً على التقارير الواردة من جهات المتابعة أو المؤسسة التعليمية.
تعليم الأبناء ما دون سن الثامنة عشر من مرحلة رياض الأطفال وحتى نهاية مرحلة الثانوية العامة أو ما يعادلها أو من عمر (3 سنوات إلى 18 سنة) أو ما يعادلها.
فيما عدا الموظف المبتعث بالانتظام الجزئي، يُعامل الموظف الأرمل / الأرملة الذي يتم ابتعاثه للدراسة خارج الدولة، أو الموظف المطلق / المطلقة الذي لديه أبناء يعولهم ويرغب في اصطحابهم إلى الدولة المبتعث إليها، معاملة المتزوج على أن يثبت وجودهم في تلك الدولة معه طوال فترة دراسته بالإثباتات الرسمية والمعتمدة من جهات المتابعة.
لا تدخل مصاريف السكن والمواصلات والملابس والتغذية والرحلات المدرسية أو أي رسوم أخرى من ضمن الرسوم الدراسية التي تتحملها الدائرة عن أبناء المبتعث.

المادة (24)

الإجازات

تطبق على إجازات المبتعث السياسات المعمول بها لدى المؤسسة التعليمية خلال فترة الابتعاث.
يجوز للطالب الالتحاق بالدراسة في الخارج قبل الموعد المحدد لبدء الدراسة بثلاثة أسابيع كحد أقصى، على أن يعود بعد إنهائه لمتطلبات تعليمه العالي أو بعد انتهاء مدة دراسته وفقًا للتقارير الواردة من المؤسسة التعليمية أو جهات المتابعة بمدة لا تجاوز (30) يوماً.

المادة (25)

الجزاءات

للدائرة الحق في تطبيق جدول المخالفات والجزاءات الواردة في الجدول (ج) المرفق بهذه اللائحة، وذلك في حال إخلال المبتعث بأي بند من بنود هذه اللائحة.

المادة (26)

تأجيل أو وقف الدراسة

يجوز للمبتعث طلب إيقاف الدراسة لمدة فصل دراسي واحد طيلة فترة الابتعاث وذلك بعد أخذ الموافقة المسبقة من الدائرة على أن يتم إخطار جهة عمل الموظف والأكاديمية في حال كان المبتعث موظفًا.
يجوز للدائرة تأجيل أو وقف تسجيل دراسة المبتعث، متى كان ذلك ضرورياً - ولمدة لا تتجاوز فصلاً دراسياً آخر أو ما يعادله، وذلك بناءً على طلب المبتعث، بعد التنسيق مع جهة عمل الموظف والأكاديمية في حالة الموظف المبتعث، وفقًا للحالات الآتية:
- وفاة الزوج أو الزوجة أو أحد أقاربه من الدرجة الأولى.
- الإصابة أو المرض الذي يستدعي تأجيل أو وقف الدراسة بشكل مؤقت شريطة موافاة الدائرة بتقرير طبي مفصل يبين فيه حالته الصحية، على أن يكون معتمدًا من الجهة الطبية المختصة بالدولة.
- إذا استدعت الحالة الصحية للمبتعث وقف الدراسة لأكثر من فصلين دراسيين، شريطة موافقة المؤسسة التعليمية الملتحق بها والدائرة مع إيقاف صرف المخصصات المالية له.
- يجوز للدائرة وبالتنسيق مع الأكاديمية وذلك بناءً على طلب جهة عمل الموظف المبتعث تأجيل أو وقف الدراسة إذا كانت حاجة العمل تستدعي ذلك.
- لا تُصرف المخصصات المالية للمبتعث عن الفصل الذي أوقف فيه دراسته، ويستثنى من ذلك بدل السكن في حال كان المبتعث طالبًا.
- لا توقف المخصصات المالية للمبتعثات اللواتي يضطرون لوقف دراستهن لفصل واحد بسبب الولادة.
- يعاد صرف المخصصات المالية للمبتعث بعد أن يتم إثبات تسجيله بشكل رسمي للدراسة بالفصل التالي.

المادة (27)

إلغاء البعثة الدراسية

لرئيس الدائرة أو من يفوضه، بناءً على توصية اللجنة، إلغاء البعثة الدراسية للمبتعث واسترداد ما صرف له في الحالات الآتية:
- إخلاله بالتزاماته وواجباته المنصوص عليها في هذه اللائحة أو عقد الابتعاث.
- فصله بموجب لوائح وأنظمة المؤسسة التعليمية الملتحق بها لأي سبب من الأسباب.
- ج. عدم تحقيقه الحد الأدنى من قواعد الأداء الأكاديمي وفقًا للجدول (ب) المرفق بهذه اللائحة.
- د. عدم تحقيقه الحد الأدنى من المعدل المطلوب لثلاثة فصول دراسية متتالية، أو رسوبه في سنتين دراستين متفرقتين أو متتاليتين حسب النظام السنوي.
- هـ. عدم إنهاء متطلبات تعليمه العالي في المدة المحددة.
- و. إذا كانت التقارير الواردة بحقه من جهات المتابعة أو المؤسسة التعليمية التي يدرس بها غير مقبولة أو إذا خالف التعليمات والتوجيهات الصادرة إليه من الدائرة.
- ز. قيامه بتغيير تخصصه أو مقر دراسته أو تعليمه العالي دون الحصول على الموافقة المسبقة من الدائرة.
- ح. عدم التحاقه بالمؤسسة التعليمية لمدة شهر اعتباراً من تاريخ بداية الدراسة دون عذر تقبله الدائرة.
- ط. تغيبه أو انسحابه من الدراسة دون عذر تقبله الدائرة.
- ي. قيامه بالتسجيل لعدد ساعات أو مواد دراسية أقل من الحد الأدنى المطلوب في كل فصل دراسي أو سنة دراسية وفق لوائح المؤسسة التعليمية.
- ك. مخالفته للتشريعات السارية أو التدخل في شؤون الدولة أو الإمارة أو السياسة العليا لأيهما أو عدم احترامه لرموزها.
- ل. إذا صدر بحقه حكم قضائي لارتكابه جناية أو جنحة مخلة بالشرف داخل الإمارة أو خارجها ما لم يرد إليه اعتباره وفق التشريعات السارية.
- م. إذا تزوج أثناء دراسته من غير مواطني مجلس التعاون الخليجي.
- ن. إذا حصل على بعثة أو منحة دراسية من جهة أخرى.
- س. إذا سجل لمواد دراسية في مؤسسة تعليمية أخرى سواء في الدولة التي يدرس فيها أو خارجها وأكملها دون موافقة الدائرة حتى وإن قبلتها جامعته الأساسية كمواد تضاف على متطلبات التعليم العالي.
للدائرة حال إلغاء البعثة الدراسية للمبتعث لأي من الأسباب الواردة في البند من هذه المادة الحق في مطالبته برد جميع المبالغ التي صرفت له أو أنفقت عليه طوال فترة دراسته.

المادة (28)

الاستثناءات والإعفاءات

لرئيس الدائرة، بناءً على توصية اللجنة وبعد موافقة المجلس التنفيذي، إعفاء المبتعث من رد كل أو بعض المخصصات المالية في أي من الحالتين الآتيتين:

إذا انقطع عن الدراسة نهائيًا أو لم يستطع إنهاء دراسته لأسباب صحية ومرضية بناءً على تقارير طبية مصدقة من جهات المتابعة ومعتمدة من اللجنة الطبية المختصة بالدولة.
إذا أصيب بعد إنهاء دراسته بمرض عضال، أو بعاهة، أو إعاقة بدنية، أو نفسية تمنعه من القيام بالوظيفة بناءً على تقرير طبي معتمد ومصدق عليه من اللجنة الطبية المختصة بالدولة.

المادة (29)

دون الإخلال بأحكام قرار المجلس التنفيذي رقم (219) لسنة 2021 المشار إليه، تسري أحكام المادتين 18 و 27 من هذه اللائحة على المخاطبين بهذا القرار، وتسري عليهم المخصصات المالية الواردة في البند ثانيًا من الجدول (أ) المرفق بهذه اللائحة.

المادة (30)

يصدر رئيس الدائرة السياسات والقرارات والأدلة الإرشادية اللازمة لتنفيذ أحكام هذه اللائحة.

المادة (31)

- يلغى القرار الإداري رقم (351) لسنة 2017 المشار إليه.

- يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.

المادة (32)

ينشر هذا القرار في الجريدة الرسمية، ويعمل به من اليوم التالي لتاريخ نشره.

Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.
And Law No. (6) of 2016 Concerning Human Resources in the Emirate of Abu Dhabi and its amendments.
And Law No. (9) of 2018 on the Establishment of the Department of Education and Knowledge.
And Law No. (15) of 2018 on the Establishment of the Abu Dhabi School of Government.
And the Chairman of the Executive Council Resolution No. (24) of 2018 Concerning Additional Competencies for the Department of Education and Knowledge.
And the Executive Council Resolution No. (219) of 2021 on Adding a Track for Medical College Graduates within the Abu Dhabi Scholarship Program.
And the Executive Council Resolution No. (123) of 2022 Concerning the Scholarship Program (Khotwa).

And based on what was presented to and approved by the Executive Council,

It is decided as follows:

Chapter One

Definitions and Application

Article (1)

Definitions

In the application of the provisions of this bylaw, the following words and phrases shall have the meanings assigned to each of them unless the context indicates otherwise:

The State	The United Arab Emirates.
The Emirate	The Emirate of Abu Dhabi.
The Government	The Government of Abu Dhabi.
The Department	Department of Education and Knowledge.
The Academy	Abu Dhabi School of Government.
The Committee	The Scholarship Committee, whose formation and work organization are determined by a resolution from the Chairman of the Department.
Government Entities	Departments, authorities, public institutions, agencies, centers, councils, funds, and any other entity affiliated with the Government.
Follow-up Entities	The State's embassies or cultural attachés abroad, or any entity authorized by the Department to follow up on scholarship students.
Scholarship Student	A citizen student, or a citizen employee in one of the Government Entities, who has been awarded a scholarship in accordance with the provisions of this bylaw.
Higher Education	The educational stage following the citizen's attainment of a high school certificate or its equivalent at an educational institution for the purpose of obtaining a higher academic degree (Diploma / Bachelor's / Master's / Doctorate), as well as medical studies and related technical fields.
Scholarship	A grant from the Government to citizen students and employees nominated to obtain a higher education qualification within or outside the Emirate in accordance with the provisions of this bylaw.
Study Leave	Leave granted to citizen employees nominated by Government Entities in the Emirate to obtain a scholarship to complete their studies at an educational institution in accordance with the provisions of this bylaw and applicable legislation.
Part-time Attendance	Studying on an intermittent basis, in compliance with the Ministry of Education's minimum requirements for the scholarship student's presence at the educational institution, whether inside or outside the Emirate.
Full-time Attendance	Studying with full attendance by the scholarship student at the educational institution, whether inside or outside the Emirate.
Educational Institution	Public and private educational entities, whether inside or outside the Emirate, including higher education and scientific research institutions licensed and accredited by the relevant authorities in the State and the Emirate.
Community Colleges	Alternative colleges for completing the first two years, at a minimum, of a bachelor's degree for international students.
Tuition Fees	The cost of higher education for a scholarship student enrolled in an educational institution in accordance with the provisions of this bylaw.
People of Determination	Any person with a total or partial, permanent or temporary impairment or disorder in their physical, sensory, mental, communicative, educational, or psychological abilities to an extent that reduces their ability to meet their normal requirements in circumstances similar to their peers without disabilities.
Financial Allocations	The monthly amount designated for the scholarship student, in addition to bonuses, allowances, and other benefits they receive, according to the categories indicated in Schedule (A) attached to this bylaw.
Family	The scholarship student's spouse(s) and children who have not reached the age of eighteen.
Companion	A companion of the scholarship student of the first or second degree of kinship in accordance with applicable legislation.
Academic Advisor	A trained and qualified person to provide necessary support to scholarship students during their studies to achieve their academic goals.
Scholarship Contract	The contract concluded between the Department and the scholarship student, which specifies the obligations and rights of both parties.
Khotwa Program	A program concerned with students of low academic performance to complete their higher education.

Article (2)

Application of the Bylaw

The provisions of this bylaw shall apply to all scholarship students, including those enrolled or continuing their studies at the time of the issuance of these provisions.
Scholarship students who received their scholarships before the issuance of this bylaw are granted three academic semesters, or their equivalent, to adjust their academic status in accordance with the provisions of this bylaw.
Adjustments to allowances and financial allocations for students on scholarships before the issuance of this bylaw will be applied after only one academic year, in accordance with Schedule (A) attached to this bylaw.

Chapter Two

Student Scholarships

Article (3)

Scope of Application

The provisions of this chapter apply to:

A student who has obtained a high school certificate or its equivalent to complete their education at an educational institution inside or outside the Emirate.
A student currently enrolled in higher education who wishes to obtain a scholarship to complete their university education at an educational institution inside or outside the Emirate.

Article (4)

Conditions for a Scholarship for a Bachelor's Degree and Below

To obtain a scholarship for a bachelor's degree and below, the following conditions and controls must be met:

Must be a citizen of the State, not less than seventeen years of age and not more than twenty-four years of age. Age is proven by a birth certificate, an official extract, or an ID card.
Obtain a score of no less than 80% on the high school certificate or its equivalent.
Obtain an accredited academic qualification for the current certificate from the competent authorities in the State that qualifies them to continue their higher education, and attach a recent academic transcript if they are currently studying.
Obtain academic admission from an educational institution. Those who have obtained academic admission to one of the top 20 universities according to the classification approved by the Department are exempt from any evaluations or admission tests that apply to other students.
Must pass the personal interview, medical examinations, and tests determined by the Committee.
Good conduct and behavior, proven by a certificate accredited by the competent authorities in the State.
The desired field of study must be one of the specializations approved by the Department.
Obtain a statement of status certificate from the National and Reserve Service.
Must not have been previously dismissed from any educational institution as a disciplinary measure.
Must not hold a scholarship from another entity.

Article (5)

Conditions for a Scholarship for the Khotwa Program

To obtain a scholarship for the Khotwa Program, the following conditions and controls must be met:

Must be a citizen of the State and not less than seventeen years of age. Age is proven by a birth certificate, an official extract, or an ID card.
Obtain a score of no less than 60% in the eleventh-grade certificate and the high school certificate or its equivalent, provided that the current certificate is accredited by the competent authorities in the State and qualifies them to continue their higher education, and attach a recent academic transcript if they are currently studying at a community college.
Obtain academic admission from a community college recommended by the Department.
For a university student enrolled in a community college recommended by the Department, obtain a cumulative GPA of (3.0) out of (4.0) points, and have completed at least (12) credit hours in the semester, accredited by the community college they are enrolled in.
Obtain a minimum score of (3.0) on the IELTS exam or (31) on the IBT TOEFL exam.
Must pass the personal interview, medical examinations, and tests determined by the Committee.
Good conduct and behavior, proven by a certificate accredited by the competent authorities in the State.
The desired field of study must be one of the specializations recommended by the Department.
Obtain a statement of status certificate from the National and Reserve Service.
Must not have been previously dismissed from any educational institution as a disciplinary measure.
Must not hold a scholarship from another entity and must not be currently employed.

Article (6)

Conditions for a Scholarship for Postgraduate Studies

To obtain a scholarship for postgraduate studies, the following conditions and controls must be met:

Must be a citizen of the State.
Obtain an accredited academic qualification from the competent authorities in the State that qualifies them to continue their higher education, and attach a recent academic transcript if they are currently studying.
Obtain academic admission from an educational institution recommended by the Department.
Must pass the personal interview, medical examinations, and tests determined by the Committee.
Good conduct and behavior, proven by a certificate accredited by the competent authorities in the State.
The desired field of study must be one of the specializations recommended by the Department.
Obtain a statement of status certificate from the National and Reserve Service.
Must not have been previously dismissed from any educational institution as a disciplinary measure.
Must not hold a scholarship from another entity.

Article (7)

Scholarship Conditions for Students of Determination

The provisions of this chapter apply to People of Determination who wish to continue their higher education at an educational institution. They shall be treated according to the following rules, conditions, and controls:

Must be a citizen of the State.
Must hold a high school certificate or its equivalent.
Obtain an accredited academic qualification for the current certificate from the competent authorities in the State that qualifies them to continue their higher education, and attach a recent academic transcript if they are currently studying.
Obtain academic admission from an educational institution recommended by the Department.
Must pass the personal interview, medical examinations, and assessment tests determined by the Committee.
Good conduct and behavior, proven by a certificate accredited by the competent authorities in the State.
Obtain a statement of status certificate from the National and Reserve Service.
Must not have been previously dismissed from any educational institution as a disciplinary measure.
Must not hold a scholarship from another entity.

Chapter Three

Study Leaves and Scholarships for Citizen Employees in Government Entities

Article (8)

Scope of Application

The provisions of this chapter apply to:

An employee nominated to continue their higher education, on a part-time or full-time basis, at an educational institution, who meets the conditions and rules for granting a study leave in accordance with applicable legislation and the rules and conditions set forth in this bylaw.
An employee who has obtained a scholarship through an educational institution or any other scholarship-granting body, or who wishes to study at their own expense, and meets the conditions for a study leave in accordance with applicable legislation.

Article (9)

- Without prejudice to the rules and provisions stipulated in the aforementioned Law No. (6) of 2016, the Academy, in coordination with the concerned Government Entity, shall prepare a list of nominated citizen employees for scholarships who have been approved after verifying their fulfillment of all conditions and conducting necessary interviews, and submit it to the Department for approval.

- The Department shall be responsible for the academic and financial follow-up of the scholarship students.

Article (10)

The Department of Health shall nominate the physician employee in a manner consistent with its applicable admission criteria and submit the nomination to the Department.

Article (11)

Scholarship Conditions for Employees of Government Entities

To grant a scholarship to an employee, the following conditions must be met:

Fulfillment of the conditions for granting a study leave as stipulated in the aforementioned Law No. (6) of 2016.
Obtain academic admission from an educational institution recommended by the Department, specifying the study plan, including the type of study, academic specialization, higher education degree, and duration of study.
The study must be full-time or part-time attendance on the campus of the educational institution, whether inside or outside the Emirate, and in compliance with the conditions of the Ministry of Education.
Obtain a statement of status certificate from the National and Reserve Service.
Must be medically fit.
Good conduct and behavior, proven by a certificate accredited by the competent authorities in the State.
For those wishing to study outside the State, must obtain a letter of accreditation for the specialization and university from the Ministry of Education.
Must hold an accredited academic qualification from the competent authorities in the State that qualifies them to continue their university education, and attach a recent academic transcript if they are currently studying.

Chapter Four

General Provisions

Article (12)

Financial Allocations for the Scholarship Student

Each student shall be paid, according to their marital status, the financial allocation specified in clause two of Schedule (A) attached to this bylaw.
Scholarship students in medical studies and related technical fields, in addition to administrative, teaching, and assistant administrative staff, shall be paid, according to their marital status, the financial allocation specified in clause three of Schedule (A) attached to this bylaw.
A student of determination on a scholarship to study abroad who has a companion shall be paid a housing allowance at the married rate according to their place of study, as per clause (two) of Schedule (A) attached to this bylaw, from their prescribed financial allocation, provided that the companion resides permanently in the country of study during the study period. If the companion leaves, the student is entitled to the housing allowance at the single rate from the financial allocation according to the aforementioned schedule.
A bonus shall be paid to postgraduate scholarship students (non-employees) if they are studying at highly ranked universities, after the official results are announced each academic year, in accordance with clause (two) of Schedule (A-Bonuses).

Article (13)

Countries of Study, Educational Institutions, and Academic Specializations

- The Committee shall propose the countries of study, educational institutions, and academic specializations recommended for study inside and outside the Emirate, and submit them to the Chairman of the Department for approval.

- A list of the approved countries of study, educational institutions, and academic specializations shall be published on the Department's website.

Article (14)

Scholarship Duration

- The duration of the scholarship is determined according to the period specified by the educational institution.

- In the event of educational justifications or additional requirements from the educational institution, or for reasons beyond the scholarship student's control, they may submit a request to the Committee to extend the scholarship duration.

- The Committee shall study the request to extend the scholarship duration and submit its recommendations to the Chairman of the Department or their delegate for approval or rejection of this request.

Article (15)

Language Study

By a decision from the Department, a scholarship student may be granted one year to study the language abroad, which may be extended for another year based on reports from the follow-up entities or the educational institution.

Article (16)

Academic Performance Rules

The academic performance of all scholarship students shall be evaluated by the competent administration for scholarship affairs at the Department, which will submit its recommendations to the Committee in coordination with the Academy. Measures outlined in Schedule (B) attached to this bylaw shall be taken regarding them, based on the evaluation results.

Article (17)

Scholarship Contract

The Department shall issue scholarship contract forms for the implementation of the provisions of this bylaw.

Article (18)

Obligations of the Scholarship Student

The scholarship student is committed to the following duties:

Adhere to the regulations and bylaws applicable at the Department, the follow-up entities, and the educational institution they are enrolled in, as well as any other obligations stipulated in the scholarship contract.
Attend classes regularly, pay attention to lessons, not be absent, and exert maximum effort in their studies to obtain the higher education certificate for which they were sent on scholarship within the specified period.
Maintain good conduct and behavior, uphold the reputation of the State, respect its customs, traditions, laws, and symbols, and represent the State in the best possible manner abroad.
Adhere to the approved study plan at the educational institution they are enrolled in and provide it to the academic advisor at the beginning of the scholarship.
Complete the practical training program as determined by the educational institution.
Not change their specialization or pursue a minor or double major without prior approval from the Department.
Not change their place of study or the higher education program they were sent for without prior approval from the Department.
Respect all laws of the host country, especially immigration and residency laws, and not interfere in its affairs or engage in any activities that violate its regulations and policies or are inconsistent with the interests of the State.
Settle and fulfill all contractual and financial obligations incumbent upon them and clear their liabilities with any entity before leaving the host country.
Prepare all required travel documents to be ready to travel at the specified time.
Commit to responding to inquiries from the academic advisor and cooperating with them through all means of communication. Failure to comply will result in disciplinary action against the scholarship student in accordance with clause (five) of Schedule (C) attached to this bylaw.
Periodically update and provide the follow-up entities, the Department, and the academic advisor with correct contact information, address, and personal and academic profile data.
Provide the Department or the academic and social advisor with their academic transcript at the end of each semester or academic year.
Designate the Department as the primary point of contact regarding their academic files.
Reside with a host family in the host country when on a scholarship to a community college.
Work for the Government Entity or the employer they are nominated to work for according to the applicable regulations and systems. In case of non-compliance, the Department has the right to demand the scholarship student to repay all financial allocations disbursed to them during their studies.
Submit a copy of their scientific research to the Department, respecting the intellectual property rights of the scholarship student, for the use of their research findings for scientific research purposes when on a scholarship for a postgraduate program.
Not retake courses they have already passed or withdraw from more than one course per year without prior approval from the Department.
The scholarship student or their legal representative must sign the scholarship contract form before starting the scholarship.
Participate in training workshops and activities organized or recommended by the Department.
Notify the Department if they obtain practical training or a job after graduation.
The employee scholarship student must return immediately after completing their higher education requirements according to reports from the educational institution or follow-up entities.

Article (19)

Allowances and Allocations

Scholarship students studying abroad, excluding employees on part-time scholarships, shall be paid the allowances specified in clause one of Schedule (A) attached to this bylaw.
A scholarship student shall be granted a financial allocation based on their place of study, academic degree, and marital status in accordance with clause two of Schedule (A) attached to this bylaw. The financial allocation shall be disbursed from the beginning of the month in which the student joins their place of study and shall continue for a maximum of two months for a scholarship student and one month for a student in the Khotwa Program after completing their university education requirements. Financial allocations and allowances for students studying abroad shall not be disbursed until all travel procedures, including obtaining the necessary visas, are completed.
Scholarship students in community colleges shall be paid, if needed at the beginning of the scholarship, a hotel accommodation allowance as stated in Schedule (A) attached to this bylaw, upon the recommendation of the Committee.
A student who has completed the prescribed study period in a community college and enrolls in a bachelor's program at an educational institution recommended by the Department is entitled to the monthly amount allocated to bachelor's students on scholarship abroad. Otherwise, the community college scholarship student will continue to receive the same monthly amount they received from the beginning of their scholarship until the end of the scholarship period.
The Department has the right to reduce or cancel all or some of the financial allocations if the student attends classes remotely or is present within the State.

Article (20)

Tuition Fees

The Department shall bear the tuition fees for the scholarship student from the beginning of the academic year semester in which the Committee's decision was issued, and any other expenses necessary to complete higher education requirements, upon the recommendation of the follow-up entities or educational institutions.
The Department shall bear the fees for preparatory programs for postgraduate study exams for scholarship students once, renewable for another period during their higher education, upon the recommendation of the follow-up entities and the approval of the Department.
The Department shall bear the tuition fees, if any, for students of the Khotwa Program to complete their studies within the State to obtain a bachelor's degree if the student's health condition requires it, based on the approval of the Medical Committee in the Emirate.
Tuition fees for the employee scholarship student shall be paid from the date of scholarship approval. The fees for the semester in which the approval was issued will also be covered, but fees for previous semesters will not be covered retroactively.

Article (21)

Travel Tickets

Scholarship students studying abroad are entitled to a cash allowance for two round-trip travel tickets (annually) in economy class or business class, depending on their health condition as approved by the competent authorities, based on ticket prices at the time of travel with the national carrier of the State. If the national carrier cannot reach the required destination, it will be done based on the prevailing prices of other companies and according to the procedures followed by the Department.
Family members of an employee on a full-time scholarship abroad are entitled to a cash allowance for two round-trip travel tickets (annually) in economy class as mentioned in the previous clause.
A companion is entitled to a cash allowance for two travel tickets for the first year of the scholarship student's enrollment. This cannot be claimed if not used within the (60) day period in the first year of the scholarship.
Scholarship students studying abroad are entitled to a cash allowance for an additional round-trip travel ticket in economy class with the approval of the Department in the following cases:
- Changing the place of study from one country to another.
- Death of a spouse or a first-degree relative.
- The scholarship student studying abroad contracts an illness that requires their return to the State, based on the recommendations of an official medical entity and the approval of the follow-up entities. The Department will determine the appropriate class for the flight ticket based on the scholarship student's health condition.
- The need to return to the State due to crises or disasters in the host country as determined by the relevant authorities.
In the event of death, the Department shall bear the costs of preparing and transporting the body of the scholarship student or one of their accompanying family members from abroad. In the former case, the person accompanying the body is entitled to an economy class travel ticket to return to the State.
No cash allowance for travel tickets or expenses stipulated in this article shall be paid to any family member of the employee scholarship student or to the companion of a scholarship student who has received a scholarship or study leave from the Department or any other entity.
An employee on scholarship studying within the State shall be provided with an airline ticket if their university education requires them to be outside the State for reasons explained in the study plan and supported by a report from the educational institution.
To be eligible for the travel ticket allowance for scholarship students and their families under this article, permanent residence in the country of study during the study period is required.
The Department has the right to suspend the travel ticket allowance if the student attends classes remotely and is present within the State.

Article (22)

Medical Treatment

With the exception of part-time scholarship students, scholarship students studying abroad are entitled to health insurance for themselves and their families according to the treatment system in place at the follow-up entities. Cosmetic procedures, including orthodontics and contact lenses, are not covered.
If health insurance does not cover the cost of treatment, the scholarship student shall submit a detailed medical report to the Department explaining the patient's health condition, which must be certified by the competent medical authority in the State.
An employee on scholarship studying within the State is entitled to medical insurance if their higher education requires them to be outside the State for reasons explained in the study plan and supported by a report from the educational institution.

Article (23)

Family Education

The Department shall bear the tuition fees for the family of an employee on a full-time scholarship abroad for the entire duration of their studies, as follows:

Language education for the spouse(s) for six months to study the language abroad, which may be extended for another six months based on reports from the follow-up entities or the educational institution.
Education for children under the age of eighteen, from kindergarten to the end of high school or its equivalent, or from age (3 to 18 years) or its equivalent.
With the exception of employees on part-time scholarships, a widowed or divorced employee who is sent on scholarship to study abroad and wishes to bring their dependent children to the host country shall be treated as a married person, provided that their presence in that country with the employee throughout the study period is proven by official and accredited documents from the follow-up entities.
Expenses for housing, transportation, clothing, food, school trips, or any other fees are not included in the tuition fees that the Department bears for the scholarship student's children.

Article (24)

Leave

The policies in effect at the educational institution regarding leave shall apply to the scholarship student during the scholarship period.
A student may travel abroad to study up to a maximum of three weeks before the scheduled start date of their studies and must return within a period not exceeding (30) days after completing their higher education requirements or after the end of their study period, according to reports from the educational institution or follow-up entities.

Article (25)

Penalties

The Department has the right to apply the schedule of violations and penalties contained in Schedule (C) attached to this bylaw in the event that the scholarship student breaches any clause of this bylaw.

Article (26)

Deferment or Suspension of Studies

A scholarship student may request to suspend their studies for one semester during the entire scholarship period, after obtaining prior approval from the Department. The employee's employer and the Academy must be notified if the scholarship student is an employee.
The Department may defer or suspend the registration of a scholarship student's studies, when necessary - for a period not exceeding another semester or its equivalent, upon the request of the scholarship student, after coordination with the employee's employer and the Academy in the case of an employee scholarship student, in the following cases:
- Death of a spouse or a first-degree relative.
- Injury or illness that requires a temporary deferment or suspension of studies, provided that a detailed medical report explaining their health condition, certified by the competent medical authority in the State, is submitted to the Department.
- If the scholarship student's health condition requires the suspension of studies for more than two semesters, subject to the approval of the educational institution they are enrolled in and the Department, with the suspension of their financial allocations.
- The Department, in coordination with the Academy, may defer or suspend studies upon the request of the employee scholarship student's employer if the needs of the work so require.
- Financial allocations shall not be paid to the scholarship student for the semester in which their studies are suspended, with the exception of the housing allowance if the scholarship student is a student.
- Financial allocations shall not be suspended for female scholarship students who have to suspend their studies for one semester due to childbirth.
- The disbursement of financial allocations to the scholarship student shall resume after they have proven their official registration for studies in the following semester.

Article (27)

Cancellation of the Scholarship

The Chairman of the Department or their delegate, upon the recommendation of the Committee, may cancel the scholarship of a student and recover what was spent on them in the following cases:
- Breach of their obligations and duties stipulated in this bylaw or the scholarship contract.
- Dismissal under the regulations and systems of the educational institution they are enrolled in for any reason.
- c. Failure to meet the minimum academic performance standards according to Schedule (B) attached to this bylaw.
- d. Failure to achieve the minimum required GPA for three consecutive semesters, or failing in two separate or consecutive academic years according to the annual system.
- e. Failure to complete their higher education requirements within the specified period.
- f. If the reports received about them from the follow-up entities or the educational institution where they study are unsatisfactory, or if they violate the instructions and directives issued to them by the Department.
- g. Changing their specialization, place of study, or higher education program without obtaining prior approval from the Department.
- h. Failure to enroll in the educational institution for a period of one month from the start date of the study without an excuse acceptable to the Department.
- i. Absence or withdrawal from studies without an excuse acceptable to the Department.
- j. Registering for a number of credit hours or courses less than the minimum required in each semester or academic year according to the regulations of the educational institution.
- k. Violation of applicable legislation, interference in the affairs of the State or the Emirate, or their high policies, or disrespect for their symbols.
- l. If a judicial verdict is issued against them for committing a felony or a misdemeanor affecting honor, inside or outside the Emirate, unless they are rehabilitated according to applicable legislation.
- m. If they marry a non-GCC citizen during their studies.
- n. If they obtain a scholarship or grant from another entity.
- o. If they register for courses at another educational institution, whether in the country where they are studying or abroad, and complete them without the Department's approval, even if their primary university accepts them as courses added to their higher education requirements.
In the event of canceling the scholarship for any of the reasons mentioned in the clause of this article, the Department has the right to demand the repayment of all amounts spent on or for the student throughout their study period.

Article (28)

Exceptions and Exemptions

The Chairman of the Department, upon the recommendation of the Committee and with the approval of the Executive Council, may exempt a scholarship student from repaying all or part of the financial allocations in either of the following two cases:

If they permanently discontinue their studies or are unable to complete their studies for health and medical reasons, based on medical reports certified by the follow-up entities and approved by the competent Medical Committee in the State.
If, after completing their studies, they suffer from a terminal illness, a permanent disability, or a physical or psychological impairment that prevents them from performing their job, based on a medical report certified and approved by the competent Medical Committee in the State.

Article (29)

Without prejudice to the provisions of Executive Council Resolution No. (219) of 2021 mentioned above, the provisions of Articles 18 and 27 of this bylaw shall apply to those addressed by that resolution, and the financial allocations stipulated in clause two of Schedule (A) attached to this bylaw shall apply to them.

Article (30)

The Chairman of the Department shall issue the necessary policies, resolutions, and guidelines for the implementation of the provisions of this bylaw.

Article (31)

- Administrative Decision No. (351) of 2017 mentioned above is hereby repealed.

- Any text or provision that contradicts or conflicts with the provisions of this resolution is hereby repealed.

Article (32)

This resolution shall be published in the Official Gazette and shall come into effect on the day following the date of its publication.
