مرسوم بقانون معدل رقم 46 لسنة 2022 بشأن تعديل المرسوم بقانون اتحادي بإنشاء مؤسسة الإمارات للتعليم
نحن محمد بن زايد آل نهيان رئيس دولة الإمارات العربية المتحدة،
بعد الاطلاع على الدستور،
وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
وعلى المرسوم بقانون اتحادي رقم (15) لسنة 2016 بإنشاء مؤسسة الإمارات للتعليم المدرسي،
وعلى المرسوم بقانون اتحادي رقم (43) لسنة 2022 بإنشاء الوكالة الاتحادية للتعليم المبكر،
وعلى المرسوم بقانون اتحادي رقم (44) لسنة 2022 بإنشاء المركز الوطني لجودة التعليم،
وبناء على ما عرضه وزير الدولة للتعليم العام والتكنولوجيا المتقدمة، وموافقة مجلس الوزراء،
أصدرنا المرسوم بقانون الآتي:
المادة (1)
يستبدل بنص المادة (4) من المرسوم بقانون اتحادي رقم (15) لسنة 2016 بإنشاء مؤسسة الإمارات للتعليم المدرسي المشار إليه، النص الآتي:
المادة (4)
تتولى المؤسسة ممارسة الاختصاصات الآتية :
- اقتراح وإعداد السياسات والاستراتيجيات والتشريعات والأنظمة الهادفة لتعزيز كفاءة قطاع التعليم العام الحكومي الاتحادي بالتنسيق مع الوزارة والجهات التعليمية وغيرها من الجهات المعنية، والعمل على تنفيذها بعد اعتمادها من مجلس الوزراء.
- إنشاء وتشغيل وإدارة وإغلاق المدارس الحكومية الاتحادية، واقتراح نماذج مبتكرة لتشغيلها ورفع كفاءتها، والعمل على تنفيذها بعد اعتمادها من مجلس الوزراء.
- توفير البنية التحتية وبيئة التعلم وبرامج التعليم في المدارس الحكومية الاتحادية، بما يتوافق مع الاستراتيجيات والسياسات المعتمدة في هذا الشأن.
- المساهمة في إعداد الإطار العام والسياسات والمعايير المتعلقة بالمنهاج التعليمي الوطني، و اقتراح التعديلات اللازمة لتحديثه، وذلك بالتنسيق مع الوزارة.
- إعداد الآليات اللازمة لتطبيق المنهاج الوطني المعتمد في المدارس الحكومية الاتحادية، بالتنسيق مع الوزارة والوكالة الاتحادية للتعليم المبكر.
- تصميم برامج وأنشطة الرعاية الطلابية والفعاليات في المدارس الحكومية الاتحادية، والإشراف على تنفيذها.
- إعداد وتنفيذ الاختبارات المدرسية التي من شأنها أن تحدد المهارات والمعارف التي اكتسبها الطلبة في مختلف المراحل الدراسية، وذلك في المدارس الحكومية الاتحادية والمدارس الخاصة التي تطبق منهاج الوزارة.
- تدريب الكوادر العاملة في المدارس الحكومية الاتحادية، وتقديم الدعم الفني لهم للنهوض بمستوى التعليم في المدارس الحكومية الاتحادية.
- اقتراح برامج ومبادرات لتطوير المدارس الحكومية الاتحادية بما في ذلك تنفيذ برامج للتقييم الذاتي وفق الإطار الوطني المعتمد لتقييم جودة التعليم بالتنسيق مع الجهات المعنية، وإعداد التقارير المتعلقة بذلك شاملاً اقتراح السياسات والتوصيات التطويرية.
- عقد المؤتمرات والندوات وورش العمل المتعلقة بمجال عمل المؤسسة، بالتنسيق مع الجهات المعنية في الدولة.
- إنشاء وإدارة قاعدة شاملة للبيانات والمعلومات المتعلقة باختصاصات المؤسسة بالتنسيق مع الوزارة والجهات التعليمية، وتحقيق التكامل في تبادل البيانات والمعلومات.
- إجراء الدراسات والبحوث التخصصية في المجالات ذات الصلة باختصاصات المؤسسة، بما في ذلك رصد وتحليل الظواهر والمخاطر والتوجهات الإقليمية والدولية.
- اقتراح الانضمام إلى المعاهدات والاتفاقيات الدولية أو التوقيع عليها، واقتراح مذكرات التفاهم و اتفاقيات الشراكة مع الدول والمنظمات والهيئات الخليجية والإقليمية والدولية المتعلقة باختصاصات المؤسسة أو الانضمام إليها، وذلك بالتنسيق مع وزارة الخارجية والتعاون الدولي والجهات المعنية.
- تمثيل الدولة في المنظمات والمعارض والمؤتمرات الإقليمية والدولية في المجالات التي تختص بها المؤسسة، وذلك بالتنسيق مع وزارة الخارجية والتعاون الدولي والجهات المعنية.
- أي اختصاصات أخرى تخول إليها بمقتضى القوانين أو اللوائح والقرارات الصادرة عن مجلس الوزراء.
المادة (2)
يضاف إلى المرسوم بقانون اتحادي رقم (15) لسنة 2016 المشار إليه مادة جديدة برقم (16) مكررا يكون نصها على النحو الآتي:

تفويض الاختصاصات وتعهيد المهام:
للمؤسسة، بعد موافقة مجلس الوزراء، تفويض بعض اختصاصاتها إلى أي جهة حكومية اتحادية أو محلية كما يجوز للمؤسسة تعهيد بعض مهامها إلى أي جهة أخرى حكومية أو خاصة بعد موافقة مجلس الوزراء.
المادة (3)
يلغى كل حكم يخالف أو يتعارض مع أحكام هذا المرسوم بقانون.
المادة (4)
ينشر هذا المرسوم بقانون في الجريدة الرسمية، ويعمل به من اليوم التالي لتاريخ نشره.

Amending Decree-Law No. 46 of 2022 concerning the amendment of the Federal Decree-Law establishing the Emirates Education Establishment
We, Mohamed bin Zayed Al Nahyan, President of the United Arab Emirates,
Having reviewed the Constitution,
And Federal Law No. (1) of 1972 concerning the Competencies of Ministries and Powers of Ministers, and its amendments,
And Federal Decree-Law No. (15) of 2016 establishing the Emirates School Establishment,
And Federal Decree-Law No. (43) of 2022 establishing the Federal Agency for Early Education,
And Federal Decree-Law No. (44) of 2022 establishing the National Centre for Education Quality,
And based on the proposal of the Minister of State for Public Education and Advanced Technology, and the approval of the Cabinet,
Have issued the following Decree-Law:
Article (1)
The text of Article (4) of the aforementioned Federal Decree-Law No. (15) of 2016 establishing the Emirates School Establishment shall be replaced with the following text:
Article (4)
The Establishment shall undertake the following competencies:
- Proposing and preparing policies, strategies, legislations, and regulations aimed at enhancing the efficiency of the federal public education sector in coordination with the Ministry, educational bodies, and other concerned authorities, and working on their implementation after their approval by the Cabinet.
- Establishing, operating, managing, and closing federal public schools, proposing innovative models for their operation and improving their efficiency, and working on their implementation after their approval by the Cabinet.
- Providing the infrastructure, learning environment, and educational programs in federal public schools, in line with the approved strategies and policies in this regard.
- Contributing to the preparation of the general framework, policies, and standards related to the national curriculum, and proposing the necessary amendments to update it, in coordination with the Ministry.
- Preparing the necessary mechanisms for applying the approved national curriculum in federal public schools, in coordination with the Ministry and the Federal Agency for Early Education.
- Designing student care programs, activities, and events in federal public schools, and supervising their implementation.
- Preparing and implementing school tests that determine the skills and knowledge acquired by students at various academic stages, in federal public schools and private schools that apply the Ministry's curriculum.
- Training the staff working in federal public schools and providing them with technical support to advance the level of education in federal public schools.
- Proposing programs and initiatives for the development of federal public schools, including implementing self-assessment programs according to the approved national framework for assessing education quality in coordination with the concerned authorities, and preparing related reports including proposing development policies and recommendations.
- Holding conferences, seminars, and workshops related to the Establishment's field of work, in coordination with the concerned authorities in the State.
- Establishing and managing a comprehensive database and information related to the Establishment's competencies in coordination with the Ministry and educational bodies, and achieving integration in the exchange of data and information.
- Conducting specialized studies and research in fields related to the Establishment's competencies, including monitoring and analyzing regional and international phenomena, risks, and trends.
- Proposing accession to or signing of international treaties and agreements, and proposing memoranda of understanding and partnership agreements with Gulf, regional, and international countries, organizations, and bodies related to the Establishment's competencies, or joining them, in coordination with the Ministry of Foreign Affairs and International Cooperation and the concerned authorities.
- Representing the State in regional and international organizations, exhibitions, and conferences in the fields of the Establishment's competence, in coordination with the Ministry of Foreign Affairs and International Cooperation and the concerned authorities.
- Any other competencies assigned to it by virtue of laws, regulations, and decisions issued by the Cabinet.
Article (2)
A new article, numbered (16) bis, shall be added to the aforementioned Federal Decree-Law No. (15) of 2016, with the following text:
Article (16) bis:
Delegation of Competencies and Outsourcing of Tasks:
The Establishment, after the approval of the Cabinet, may delegate some of its competencies to any federal or local government entity. The Establishment may also outsource some of its tasks to any other government or private entity after the approval of the Cabinet.
Article (3)
Any provision that violates or contradicts the provisions of this Decree-Law shall be repealed.
Article (4)
This Decree-Law shall be published in the Official Gazette and shall come into force on the day following the date of its publication.
