قرار وزاري رقم (24) لسنة 2021م بشأن تحديث تاريخ احتساب سن قبول الطلبة في المدارس الحكومية والخاصة

بعد الاطلاع على القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء وتعديلاته
وعلى القانون الاتحادي رقم (29) لسنة 2006 بشأن حقوق المعاقين والمعدل بالقانون رقم (14) لسنة 2009م .
وعلى المرسوم بقانون اتحادي رقم (15) لسنة 2016 بإنشاء مؤسسة الإمارات للتعليم المدرسي .
وعلى القانون الاتحادي رقم (3) لسنة 2016 بشأن قانون حقوق الطفل (وديمة).
وعلى المرسوم بقانون اتحادي رقم (18) لسنة 2020 بشأن التعليم الخاص
وعلى قرار مجلس الوزراء رقم (24) لسنة 2001 بشأن تنظيم قبول أبناء الوافدين في المراحل التعليمية وتعديلاته .
وعلى قرار مجلس الوزراء رقم (1/185) لسنة 2001 بشأن الموافقة على إعادة تنظيم التعليم الابتدائي والإعدادي ومدة سنوات الإلزام .
وعلى قرار مجلس الوزراء رقم (30/486) لسنة 2001م بشأن تنظيم قبول أبناء الوافدين في المدارس الحكومية .
وعلى قرار مجلس الوزراء رقم (29م/16 و 2020م) بشأن الموافقة على اعتماد الهيكل التنظيمي لوزارة التربية والتعليم .
وعلى القرار الوزاري رقم (619) لسنة 2017م، بشأن لائحة إدارة سلوك الطلبة في مؤسسات التعليم العام .
وعلى القرار الوزاري رقم (820) لسنة 2014م، بشأن لائحة تسجيل الطلبة .
وعلى القرار الوزاري رقم (166) لسنة 2010م، بشأن اعتماد القواعد العامة لبرامج التربية الخاصة .
وعلى القرار الوزاري رقم (5) لسنة 2021م، بشأن تحديث تاريخ احتساب سن قبول الطلبة في المدارس الحكومية والخاصة.
وعلى كتاب الأمين العام لمجلس التعليم والموارد البشرية رقم (م . ج . ت / أ/ 1509) المؤرخ في 2021/1/10 بتوصيات مجلس التعليم والموارد البشرية بشأن تاريخ احتساب سن قبول الطلبة .
وعلى ما تقتضيه المصلحة العامة.
قرر ما يلي:
المادة الأولى: يتم تحديث تاريخ احتساب سن قبول الطلبة الوارد في القرار الوزاري رقم (820) لسنة 2014م بشأن لائحة تسجيل الطلبة وفقًا للضوابط والاشتراطات الآتية :
أولاً: يتم احتساب سن قبول الطلبة في المدارس المبينة أدناه ليتم قبول من أكمل السن المعتمد للتسجيل في 31/ أغسطس من العام الدراسي الذي يقبل فيه، وذلك بدءًا من العام الدراسي 2021/2022 وبحسب الجدول الملحق بهذا القرار (ملحق 1) :
* المدارس الحكومية
* المدارس الخاصة التي تتبع منهاج الوزارة
* المدارس الخاصة التي تتبع المناهج الأجنبية الدولية ويبدأ عامها الدراسي في شهر سبتمبر
ثانيًا: يتم احتساب سن قبول الطلبة في المدارس الخاصة التي يبدأ عامها الدراسي في شهر إبريل ليتم قبول من أكمل السن المعتمد للتسجيل في 31/ مارس من العام الدراسي الذي يقبل فيه بدءًا من العام الدراسي 2022/2023م، وبحسب الجدول الملحق بهذا القرار (ملحق 2) .
ثالثًا: تكون مسميات الصفوف للمدارس المذكورة بهذا القرار وفق النظام الذي تتبعه كل منها وبحسب الجدول الملحق بهذا القرار (3)
رابعًا: لا يتم قبول أي استثناءات على التواريخ المحددة في هذا القرار .
خامسًا: تتم دراسة حالة الطلبة القادمين من خارج الدولة ويتم تسجيلهم في مدارس الدولة بناءً على استيفائهم لسن القبول المعتمد .
المادة الثانية: تطبق التواريخ المحدثة الواردة في المادة الأولى من هذا القرار على تسجيل الطلبة الجدد دون التأثير على الطلبة الملتحقين حاليًا في كل صف والمنتقلين إلى الصفوف التالية.
المادة الثالثة: يلغى القرار الوزاري رقم (5) لسنة 2021م بشأن تحديث تاريخ احتساب سن قبول الطلبة في المدارس الحكومية والخاصة كما تلغى أية أحكام تتعارض مع أحكام هذا القرار .
المادة الرابعة: يبلغ هذا القرار لجميع جهات الاختصاص لتنفيذه كل فيما يخصه والعمل به بدءًا من الأعوام الدراسية المحددة في المادة الأولى من هذا القرار.

Ministerial Decree No. (24) of 2021 concerning updating the date for calculating the admission age of students in public and private schools
The Minister of Education
Having reviewed Federal Law No. (1) of 1972 concerning the competencies of ministries and the powers of ministers, and its amendments
And Federal Law No. (29) of 2006 concerning the rights of persons with disabilities, as amended by Law No. (14) of 2009.
And Federal Decree-Law No. (15) of 2016 on the establishment of the Emirates Schools Establishment.
And Federal Law No. (3) of 2016 concerning the Child Rights Law (Wadeema).
And Federal Decree-Law No. (18) of 2020 concerning Private Education.
And Cabinet Resolution No. (24) of 2001 concerning the regulation of the admission of expatriate children in educational stages, and its amendments.
And Cabinet Resolution No. (1/185) of 2001 concerning the approval of the reorganization of primary and preparatory education and the duration of compulsory years.
And Cabinet Resolution No. (30/486) of 2001 concerning the regulation of the admission of expatriate children in public schools.
And Cabinet Resolution No. (29m/16 of 2020) concerning the approval of the organizational structure of the Ministry of Education.
And Ministerial Decree No. (619) of 2017 concerning the Student Conduct Management Regulation in public education institutions.
And Ministerial Decree No. (820) of 2014 concerning the Student Registration Regulation.
And Ministerial Decree No. (166) of 2010 concerning the adoption of the general rules for special education programs.
And Ministerial Decree No. (5) of 2021 concerning updating the date for calculating the admission age of students in public and private schools.
And the letter of the Secretary-General of the Education and Human Resources Council No. (E.H.R.C/A/1509) dated 10/1/2021 with the recommendations of the Education and Human Resources Council regarding the date for calculating the admission age of students.
And based on the public interest.
Has decided the following:
Article 1: The date for calculating the admission age of students mentioned in Ministerial Decree No. (820) of 2014 concerning the Student Registration Regulation shall be updated in accordance with the following controls and conditions:
First: The admission age of students in the schools listed below shall be calculated to accept those who have completed the approved age for registration by August 31 of the academic year in which they are admitted, starting from the academic year 2021/2022 and according to the table attached to this decree (Appendix 1):
* Public schools
* Private schools that follow the Ministry's curriculum
* Private schools that follow international foreign curricula and whose academic year begins in September
Second: The admission age of students in private schools whose academic year begins in April shall be calculated to accept those who have completed the approved age for registration by March 31 of the academic year in which they are admitted, starting from the academic year 2022/2023, and according to the table attached to this decree (Appendix 2).
Third: The grade names for the schools mentioned in this decree shall be according to the system each one follows and as per the table attached to this decree (3).
Fourth: No exceptions to the dates specified in this decree will be accepted.
Fifth: The cases of students coming from outside the country will be studied, and they will be registered in the country's schools based on their fulfillment of the approved admission age.
Article 2: The updated dates mentioned in Article 1 of this decree shall apply to the registration of new students without affecting the currently enrolled students in each grade and those moving to the following grades.
Article 3: Ministerial Decree No. (5) of 2021 concerning updating the date for calculating the admission age of students in public and private schools is hereby repealed, as are any provisions that conflict with the provisions of this decree.
Article 4: This decree shall be communicated to all competent authorities for its implementation, each within its jurisdiction, and shall be effective starting from the academic years specified in Article 1 of this decree.
