قرار مجلس الوزراء رقم (37) لسنة 2015 بشأن اللائحة المالية للقانون الاتحادي رقم (4) لسنة 1984
بشأن البعثات التعليمية والمساعدات الدراسية
مجلس الوزراء،
-بعد الاطلاع على الدستور،
-وعلى القانون الاتحادي رقم (1) لسنة 1972 ، في شأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
-وعلى القانون الاتحادي رقم (4) لسنة 1984، في شأن البعثات التعليمية والمساعدات الدراسية،
-وعلى القانون الاتحادي رقم (4) لسنة 1992، في شأن إنشاء وزارة التعليم العالي والبحث العلمي،
-وعلى القانون الاتحادي رقم (29) لسنة 2006 ، في شأن حقوق ذوي الاحتياجات الخاصة، وتعديلاته،
-وعلى المرسوم بقانون اتحادي رقم (11) لسنة 2008 ، بشأن الموارد البشرية في الحكومة الاتحادية، وتعديلاته،
-وعلى المرسوم بقانون اتحادي رقم (8) لسنة 2011، بشأن قواعد إعداد الميزانية العامة والحساب الختامي،
- وعلى قرار مجلس الوزراء رقم (5) لسنة 1985 في شأن اللائحة المالية للقانون الاتحادي رقم (4) لسنة 1984، في شأن البعثات التعليمية والمساعدات الدراسية، وتعديلاته،
-وعلى قرار مجلس الوزراء رقم (3) لسنة 2008، في شأن الهيكل التنظيمي لوزارة التعليم العالي والبحث العلمي،
-وعلى قرار مجلس الوزراء رقم (15) لسنة 2013 ، بشأن لائحة الموارد البشرية للجهات الاتحادية المستقلة،
-وبناءً على ما عرضه وزير التعليم العالي والبحث العلمي، وموافقة مجلس الوزراء،
قرر:
المادة (1)
التعريفات
في تطبيق أحكام هذه اللائحة، يقصد بالكلمات والعبارات التالية، المعاني المبينة قرين كل منها ما لم يدل سياق النص على غير ذلك :
الدولة: الإمارات العربية المتحدة .
الوزارة: وزارة التعليم العالي والبحث العلمي .
الوزير: وزير التعليم العالي والبحث العلمي .
اللجنة: لجنة البعثات المشكلة بموجب أحكام القانون الاتحادي رقم (4) لسنة 1984، المشار إليه .
مسؤول البعثات: المستشار أو الملحق الثقافي في سفارة الدولة أو من يقوم بعمل أي منهما في البلد المبتعث إليه طالب البعثة .
الموفد (طالب البعثة): الطالب المواطن الحاصل على بعثة دراسية داخل الدولة أو خارجها .
المؤسسة التعليمية: أي مؤسسة يلتحق بها طالب البعثة، داخل الدولة أو خارجها .
الزوج: زوج أو زوجة طالب البعثة، حسب مقتضى الحال.
المادة (2)
المخصصات المالية لطالب البعثة
-1 يستحق طالب البعثة الراتب الشهري المبين في الجدول أدناه، وفقًا للقيمة المالية الموضحة والبلد المبتعث إليه:

-2 بالإضافة إلى الراتب الشهري، الوارد في الفقرة (1) من هذه المادة، يستحق طالب البعثة المخصصات والبدلات المالية الآتية :
أ- بدل نقدي للاستعداد للسفر قدره (6000) ستة آلاف درهم، تصرف لمرة واحدة طيلة مدة الابتعاث .
ب- قيمة تذكرة سفر على الدرجة السياحية، ذهابًا وإيابًا، من مقر إقامة طالب البعثة إلى البلد المبتعث إليه، وذلك لمرة واحدة عن كل سنة دراسية، ويجوز منح تذكرة سفر إضافية في أي حالة تستدعي عودة طالب البعثة إلى الدولة، وذلك بناءً على توصية من مسؤول البعثات وموافقة الوزير .
ج - الرسوم الدراسية المعتمدة ضمن الخطة الدراسية، على أن يتم دفع هذه الرسوم بموجب الوثائق والمستندات المعتمدة من المؤسسة التعليمية، بعد تصديقها من مسؤول البعثات .
د- نفقات التأمين الصحي، أو نفقات العلاج أو الأدوية في حال عدم وجود جهة تأمينية مسؤولة عن تغطية هذه النفقات، على أن يتم تقديم الوثائق والمستندات اللازمة، بعد تصديقها من مسؤول البعثات .
هـ - نفقات الإقامة الكاملة بما لا يزيد على (6) ست ليال من تاريخ وصول طالب البعثة لأول مرة إلى البلد المبتعث إليه، وذلك وفق نظام الحجز المعتمد لدى الوزارة .
و - بدل نقدي لشراء كتب ولوازم دراسية قدره (6000) ستة آلاف درهم، يتم صرفها عن كل سنة دراسية .
-3 يجوز للوزارة سداد أية رسوم أو نفقات أخرى بموجب وثائق أصولية مصدقة من مسؤول البعثات .
-4 تحدد اللجنة المعايير والشروط اللازمة لاستحقاق الراتب الشهري للطالب المتميز، وفقًا لما هو مبين في الفقرة (1) من هذه المادة.
المادة (3)
المخصصات والبدلات المالية للموظف المبتعث
يستحق موظف الحكومة الاتحادية أو المحلية، الحاصل على إجازة دراسية براتب، كافة المخصصات والبدلات المالية المنصوص عليها في هذه اللائحة، وذلك باستثناء الراتب الشهري المبين في الفقرة (1) من المادة (2) من هذه اللائحة.
المادة (4)
المخصصات المالية لطالب البعثة من المعاقين
-1 يجوز للوزير منح مساعدة دراسية لأي من الطلبة المعاقين من المواطنين، للدراسة في مؤسسات تعليمية في الخارج، على أن يعادل مقدار هذه المساعدة الدراسية قيمة المخصصات والبدلات المالية المقررة لطالب البعثة المنصوص عليها في هذه اللائحة .
-2 تتحمل الوزارة كافة المصروفات المتعلقة بالوسائل والأدوات والأجهزة والمعدات اللازمة لطالب البعثة من المعاقين، على أن يتم تقديم الوثائق والمستندات الأصولية المعتمدة من الجهات الصحية المختصة.
المادة (5)
المخصصات المالية عن الزوج والأبناء
-1 بالإضافة إلى الراتب الشهري والمخصصات والبدلات المالية، المنصوص عليها في المادة (2) من هذه اللائحة، يستحق طالب البعثة البدلات المالية التالية عن زوجه و أبناءه :
أ- قيمة تذكرة سفر على الدرجة السياحية، للزوج والأبناء دون سن الثامنة عشر، ذهابًا وإيابًا من مقر الإقامة إلى البلد المبتعث إليه، وذلك لمرة واحدة في السنة الدراسية .
ب- بدل سكن، بما يعادل (50%) من قيمة الراتب الشهري المبين في الفقرة (1) من المادة (2) من هذه اللائحة، على أن يصرف ضمن الراتب الشهري .
-2 يشترط لصرف البدلات المالية، المنصوص عليها في الفقرة (1) من هذه المادة، مرافقة الزوج والأبناء وإقامتهم الدائمة مع طالب البعثة في البلد المبتعث إليه، على أن يقدم طالب البعثة الوثائق والمستندات التي تثبت استحقاقه لهذه البدلات المالية بعد تصديقها من مسؤول البعثات .
-3 لا يتم صرف أي من البدلات المالية المنصوص عليها في هذه المادة، في حال كان الزوج المرافق حاصلاً على إجازة دراسية براتب أو بعثة أو مساعدة دراسية من الوزارة أو من أي جهة أخرى.
المادة (6)
توفير السكن ونفقات الإقامة
-1 تقوم الوزارة بتأمين سكن مؤثث لطالبات البعثة ووسائل النقل اللازمة لهن، شريطة ألا يقل عددهن عن ثلاث طالبات، وألا يتجاوز إجمالي التكلفة الشهرية للسكن ووسائل النقل (5000) خمسة آلاف درهم، وذلك مقابل استقطاع نسبة (30%) من الراتب الشهري لكل طالبة بعثة .
-2 يجوز للوزارة أن تتحمل كافة نفقات الإقامة والسكن في حال كانت الأنظمة المعمول بها في المؤسسات التعليمية تستوجب الإقامة في أقسامها الداخلية أو كان ذلك بناءً على رغبة طالب البعثة، على أن يخصم في هذه الحالة من طالب البعثة (50%) من الراتب الشهري الذي يتقاضاه أو (25%) من الراتب الشهري في حال تحملت الوزارة نفقات سكن الطالب المبتعث دون تكاليف إقامته.
المادة (7)
نفقات شحن الأمتعة الإضافية
يصرف لطالب البعثة المتخرج مقابل نفقات شحن أمتعته الإضافية، بدلاً نقدياً قدره (2000) ألفي درهم.
المادة (8)
البعثة الدراسية لحامل جواز سفر الدولة دون خلاصة قيد
يجوز بقرار من الوزير بناء على توصية اللجنة، منح بعثة دراسية في الخارج للطالب الذي يحمل جواز سفر الدولة دون خلاصة القيد، على أن تصرف له كافة المخصصات والبدلات المالية المنصوص عليها في المادة (2) من هذه اللائحة، وذلك باستثناء البدلات المالية التي يتم صرفها للزوج والأبناء المنصوص عليها في المادة (5) من هذه اللائحة.
المادة (9)
المخصصات المالية لطلبة الانتساب (الانتظام الجزئي) في الخارج
-1 يجوز للوزير بناءً على توصية اللجنة، منح طلبة الانتساب (الانتظام الجزئي) من المواطنين الذين يتابعون دراساتهم العليا في الخارج، بعد حصولهم على الشهادة الجامعية الأولى، المخصصات والبدلات المالية الآتية :
أ- الرسوم الدراسية، على أن يتم دفع الرسوم بموجب الوثائق والمستندات المعتمدة من المؤسسة التعليمية، وذلك بعد تصديقها من مسؤول البعثات .
ب- قيمة تذكرة سفر على الدرجة السياحية، ذهابًا وإيابًا، من الدولة إلى بلد المؤسسة التعليمية المنتسب إليها، وذلك لمتابعة دراسته، ولمرة واحدة في السنة الدراسية .
ج- مبلغ مالي مقطوع لا يتجاوز الراتب الشهري الذي يتقاضاه طالب البعثة في ذات المستوى الدراسي، وذلك لمرة واحدة في السنة الدراسية، والمنصوص عليه في المادة (2) من هذه اللائحة .
د- نفقات التأمين الصحي أو نفقات العلاج أو الأدوية في حال عدم وجود جهة تأمينية مسؤولة عن تغطية هذه النفقات طيلة مدة وجوده في بلد المؤسسة التعليمية المنتسب إليها لمتابعة دراسته، على أن يتم تقديم الوثائق والمستندات اللازمة، بعد تصديقها من مسؤول البعثات .
-2 لا تلتزم الوزارة بصرف أي من المخصصات والبدلات المالية المنصوص عليها في الفقرة (1) من هذه المادة، بصفة مستمرة، إلا بعد تقديم طالب الانتساب (الانتظام الجزئي) كافة الأوراق والمستندات التي تثبت متابعته لدراساته العليا بشكل سنوي.
المادة (10)
البعثات الدراسية داخل الدولة
يجوز للوزير، بناء على توصية اللجنة، منح بعثة دراسية لأي من الطلبة المواطنين الملتحقين بمؤسسات التعليم العالي داخل الدولة، على أن تتحمل الوزارة قيمة الرسوم الدراسية دون غيرها من المخصصات أو البدلات المالية المنصوص عليها في هذه اللائحة.
المادة (11)
المساعدات الدراسية للطلبة غير المواطنين
يجوز بقرار من مجلس الوزراء، بناء على اقتراح الوزير، منح مساعدات دراسية للطلبة غير المواطنين الملتحقين بالمؤسسات التعليمية داخل الدولة أو خارجها، على أن يتضمن القرار المخصصات المالية اللازمة لذلك.
المادة (12)
المكافآت والحوافز لطالب البعثة
يجوز للوزير بناءً على توصية اللجنة، منح مكافأة مالية لطالب البعثة المتفوق بما لا يزيد على قيمة راتب شهر، وفقًا لما هو منصوص عليه في المادة (2) من هذه اللائحة، وذلك لمرة واحدة في السنة الدراسية، سواء كانت بعثة الطالب براتب أو دون راتب، وذلك وفقًا للائحة المكافآت والحوافز للطلبة، المعتمدة في الوزارة.
المادة (13)
أحكام ختامية
-1 يجوز للوزير بناء على توصية اللجنة، الاستمرار في صرف أي من المخصصات أو البدلات المالية، المنصوص عليها في هذه اللائحة، في حال تجاوزت مدة دراسة طالب البعثة عدد السنوات المحددة في قرار ابتعاثه الصادر عن الوزارة .
-2 تتحمل الوزارة بالنسبة لطالب البعثة الموفد بناء على منحة دراسية مقدمة من بلد آخر الفروق في المخصصات المالية بين ما يقدمه هذا البلد، وما يستحقه الطالب وفقًا لأحكام هذه اللائحة .
-3 يحدد سعر تذكرة السفر التي يتم صرفها للطالب المبتعث أو الزوج أو الأبناء، وفقًا لأحكام هذه اللائحة، بموجب قرار يصدره الوزير لهذه الغاية .
-4 يجوز بموافقة الوزير صرف تذكرة سفر بدرجة رجال الأعمال عن كل سنة من سنوات الإيفاد وفقًا للحالة الصحية للطالب، وذلك بناء على تقارير طبية مصدقة من الجهات المختصة .
-5 لا تشمل نفقات التأمين الصحي أو نفقات العلاج أو الأدوية، المنصوص عليها في هذه اللائحة، النفقات المترتبة على أي معالجات تجميلية.
المادة (14)
أحكام انتقالية
يستمر صرف المخصصات والبدلات المالية الممنوحة لطالب البعثة عن الزوج والأبناء بموجب أحكام قرار مجلس الوزراء رقم (5) لسنة 1985، المشار إليه، والتي لم يرد النص عليها في هذه اللائحة إلى حين انتهاء مدة ابتعاثه.
المادة (15)
الإلغاءات
يلغى قرار مجلس الوزراء رقم (5) لسنة 1985 في شأن اللائحة المالية للقانون الاتحادي رقم (4) لسنة 1984 بشأن البعثات التعليمية والمساعدات الدراسية، كما يلغى كل حكم يخالف أو يتعارض مع أحكام هذه اللائحة.
المادة (16)
إصدار القرارات التنفيذية
يصدر الوزير القرارات التنفيذية اللازمة لتنفيذ أحكام هذه اللائحة.
المادة (17)
النشر والسريان
يعمل بهذه اللائحة من تاريخ 1 نوفمبر 2015، وتنشر في الجريدة الرسمية.

ملاحظة
نصت المادة (الأولى/5) من مرسوم بقانون اتحادي رقم (26) لسنة 2024 على :
" يلغى العمل بالقانون الاتحادي رقم (4) لسنة 1984 في شأن البعثات والمساعدات الدراسية"،
كما نصت المادة (الثانية) من ذات المرسوم على" :
1. تبقى قرارات الابتعاث وتقديم المساعدات الدراسية الصادرة استنادًا لأحكام القانون الاتحادي رقم (4) لسنة 1984 المشار إليه والقائمة وقت نفاذ هذا المرسوم بقانون سارية ما دامت مستوفية لشروط استمرارها.
2. يستمر صرف المخصصات المالية للبعثات والمساعدات الدراسية المنصوص عليها في البند (1) من هذه المادة وفقًا للقرارات النافذة في شأنها، وذلك إلى حين الانتهاء منها أو صدور قرار من مجلس الوزراء بإنهائها للمصلحة العامة.
3. يستمر العمل باللوائح والقرارات الصادرة تنفيذًا لأحكام القانون الاتحادي رقم (4) لسنة 1984 إلى حين انتهاء العمل بقرارات الابتعاث وتقديم المساعدات المشار إليها في البند (1) من هذه المادة أو صدور ما يحل محلها بموجب القرارات التي تصدر عن مجلس الوزراء".. لذا اقتضى التنويه.
تنويه تعديل مسميات :
نصت المادة 5/13 من مرسوم بقانون اتحادي رقم (14) لسنة 2016 على أن تحل وزارة التربية والتعليم محل وزارة التعليم العالي والبحث العلمي في كافة التشريعات المتعلقة بالاختصاصات المبينة في المادة (8) منه ، وفي كافة الحقوق والالتزامات بما في ذلك الحقوق والالتزامات الواردة في أية عقود أو اتفاقيات أو مذكرات تفاهم أبرمتها الوزارة.

Concerning Educational Missions and Study Aids
The Cabinet,
-Having reviewed the Constitution,
-And Federal Law No. (1) of 1972, concerning the competencies of ministries and the powers of ministers, and its amendments,
-And Federal Law No. (4) of 1984, concerning educational missions and study aids,
-And Federal Law No. (4) of 1992, concerning the establishment of the Ministry of Higher Education and Scientific Research,
-And Federal Law No. (29) of 2006, concerning the rights of people with special needs, and its amendments,
-And Federal Decree-Law No. (11) of 2008, concerning human resources in the Federal Government, and its amendments,
-And Federal Decree-Law No. (8) of 2011, concerning the rules for preparing the general budget and the final account,
-And Cabinet Resolution No. (5) of 1985 concerning the financial regulations of Federal Law No. (4) of 1984, concerning educational missions and study aids, and its amendments,
-And Cabinet Resolution No. (3) of 2008, concerning the organizational structure of the Ministry of Higher Education and Scientific Research,
-And Cabinet Resolution No. (15) of 2013, concerning the human resources regulations for independent federal entities,
-And based on the proposal of the Minister of Higher Education and Scientific Research, and the approval of the Cabinet,
Has decided:
Article (1)
Definitions
In the application of the provisions of these regulations, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
The State: The United Arab Emirates.
The Ministry: The Ministry of Higher Education and Scientific Research.
The Minister: The Minister of Higher Education and Scientific Research.
The Committee: The Missions Committee formed under the provisions of the aforementioned Federal Law No. (4) of 1984.
Missions Officer: The advisor or cultural attaché at the State's embassy or whoever performs the work of either of them in the country to which the scholarship student is sent.
The Delegate (Scholarship Student): The national student who has obtained a scholarship to study inside or outside the State.
Educational Institution: Any institution in which the scholarship student is enrolled, inside or outside the State.
Spouse: The husband or wife of the scholarship student, as the case may be.
Article (2)
Financial Allocations for the Scholarship Student
-1 The scholarship student is entitled to the monthly salary shown in the table below, according to the specified financial value and the country of study:

-2 In addition to the monthly salary mentioned in Paragraph (1) of this Article, the scholarship student is entitled to the following financial allocations and allowances:
a- A cash allowance for travel preparation amounting to (6000) six thousand dirhams, disbursed once throughout the scholarship period.
b- The value of one round-trip economy class airline ticket from the scholarship student's place of residence to the country of study, once for each academic year. An additional airline ticket may be granted in any case requiring the student's return to the State, based on a recommendation from the Missions Officer and the Minister's approval.
c- Tuition fees approved within the study plan, provided that these fees are paid upon submission of documents and records approved by the educational institution, after their attestation by the Missions Officer.
d- Health insurance expenses, or treatment or medication expenses in the absence of an insurance entity responsible for covering these expenses, provided that the necessary documents and records are submitted, after their attestation by the Missions Officer.
e- Full accommodation expenses for a period not exceeding (6) six nights from the date of the scholarship student's first arrival in the country of study, in accordance with the booking system approved by the Ministry.
f- A cash allowance for the purchase of books and study supplies amounting to (6000) six thousand dirhams, to be disbursed for each academic year.
-3 The Ministry may pay any other fees or expenses upon submission of original documents attested by the Missions Officer.
-4 The Committee shall determine the criteria and conditions necessary for a distinguished student to be eligible for the monthly salary, as shown in Paragraph (1) of this Article.
Article (3)
Financial Allocations and Allowances for the Seconded Employee
A federal or local government employee on a paid study leave is entitled to all financial allocations and allowances stipulated in these regulations, with the exception of the monthly salary shown in Paragraph (1) of Article (2) of these regulations.
Article (4)
Financial Allocations for Scholarship Students with Disabilities
-1 The Minister may grant a study aid to any citizen student with a disability to study in educational institutions abroad, provided that the amount of this study aid is equivalent to the value of the financial allocations and allowances prescribed for a scholarship student as stipulated in these regulations.
-2 The Ministry shall bear all expenses related to the means, tools, devices, and equipment necessary for the scholarship student with a disability, provided that original documents and records approved by the competent health authorities are submitted.
Article (5)
Financial Allocations for Spouse and Children
-1 In addition to the monthly salary and the financial allocations and allowances stipulated in Article (2) of these regulations, the scholarship student is entitled to the following financial allowances for his spouse and children:
a- The value of one round-trip economy class airline ticket for the spouse and children under the age of eighteen, from the place of residence to the country of study, once per academic year.
b- A housing allowance, equivalent to (50%) of the value of the monthly salary shown in Paragraph (1) of Article (2) of these regulations, to be disbursed with the monthly salary.
-2 The disbursement of the financial allowances stipulated in Paragraph (1) of this Article is conditional upon the spouse and children accompanying and residing permanently with the scholarship student in the country of study, provided that the student submits the documents and records proving his eligibility for these financial allowances, after their attestation by the Missions Officer.
-3 None of the financial allowances stipulated in this Article shall be disbursed if the accompanying spouse is on a paid study leave or has a scholarship or study aid from the Ministry or any other entity.
Article (6)
Provision of Housing and Accommodation Expenses
-1 The Ministry shall provide furnished housing and necessary transportation for female scholarship students, provided that their number is not less than three students, and that the total monthly cost of housing and transportation does not exceed (5000) five thousand dirhams, in exchange for a deduction of (30%) from the monthly salary of each female scholarship student.
-2 The Ministry may bear all accommodation and housing expenses if the regulations in effect at the educational institutions require residence in their dormitories or if it is at the request of the scholarship student. In this case, (50%) of the monthly salary received by the student shall be deducted, or (25%) of the monthly salary if the Ministry bears the student's housing expenses without his accommodation costs.
Article (7)
Excess Baggage Shipping Expenses
A graduating scholarship student shall be paid a cash allowance of (2000) two thousand dirhams for excess baggage shipping expenses.
Article (8)
Scholarship for Holder of a State Passport without a Family Book Registration
By a decision of the Minister, based on the Committee's recommendation, a scholarship abroad may be granted to a student who holds a State passport without a family book registration. All financial allocations and allowances stipulated in Article (2) of these regulations shall be disbursed to him, with the exception of the financial allowances disbursed for the spouse and children as stipulated in Article (5) of these regulations.
Article (9)
Financial Allocations for Part-Time (External) Students Abroad
-1 The Minister may, based on the Committee's recommendation, grant part-time (external) citizen students pursuing their higher studies abroad, after obtaining their first university degree, the following financial allocations and allowances:
a- Tuition fees, provided that the fees are paid upon submission of documents and records approved by the educational institution, after their attestation by the Missions Officer.
b- The value of one round-trip economy class airline ticket from the State to the country of the educational institution he is affiliated with, to follow up on his studies, once per academic year.
c- A lump sum not exceeding the monthly salary received by a scholarship student at the same level of study, once per academic year, as stipulated in Article (2) of these regulations.
d- Health insurance expenses or treatment or medication expenses in the absence of an insurance entity responsible for covering these expenses throughout his stay in the country of the educational institution he is affiliated with to follow up on his studies, provided that the necessary documents and records are submitted, after their attestation by the Missions Officer.
-2 The Ministry is not obligated to continuously disburse any of the financial allocations and allowances stipulated in Paragraph (1) of this Article, except after the part-time (external) student submits all the papers and documents that prove he is following up on his higher studies annually.
Article (10)
Scholarships within the State
The Minister may, based on the Committee's recommendation, grant a scholarship to any citizen student enrolled in higher education institutions within the State, provided that the Ministry bears the value of the tuition fees only, excluding other allocations or financial allowances stipulated in these regulations.
Article (11)
Study Aids for Non-Citizen Students
By a decision of the Cabinet, based on the Minister's proposal, study aids may be granted to non-citizen students enrolled in educational institutions inside or outside the State, provided that the decision includes the necessary financial allocations for that purpose.
Article (12)
Rewards and Incentives for the Scholarship Student
The Minister may, based on the Committee's recommendation, grant a financial reward to an outstanding scholarship student not exceeding the value of one month's salary, as stipulated in Article (2) of these regulations, once per academic year, whether the student's scholarship is with or without a salary, in accordance with the student rewards and incentives regulations approved by the Ministry.
Article (13)
Concluding Provisions
-1 The Minister may, based on the Committee's recommendation, continue to disburse any of the allocations or financial allowances stipulated in these regulations, in the event that the scholarship student's period of study exceeds the number of years specified in his scholarship decision issued by the Ministry.
-2 For a scholarship student sent on a grant provided by another country, the Ministry shall bear the differences in financial allocations between what that country provides and what the student is entitled to according to the provisions of these regulations.
-3 The price of the airline ticket disbursed to the scholarship student, spouse, or children, in accordance with the provisions of these regulations, shall be determined by a decision issued by the Minister for this purpose.
-4 With the Minister's approval, a business class airline ticket may be disbursed for each year of the secondment according to the student's health condition, based on medical reports certified by the competent authorities.
-5 The health insurance, treatment, or medication expenses stipulated in these regulations do not include expenses resulting from any cosmetic treatments.
Article (14)
Transitional Provisions
The disbursement of financial allocations and allowances granted to the scholarship student for the spouse and children under the provisions of the aforementioned Cabinet Resolution No. (5) of 1985, which are not mentioned in these regulations, shall continue until the end of his scholarship period.
Article (15)
Repeals
Cabinet Resolution No. (5) of 1985 concerning the financial regulations of Federal Law No. (4) of 1984 regarding educational missions and study aids is hereby repealed, as is any provision that contradicts or conflicts with the provisions of these regulations.
Article (16)
Issuance of Executive Decisions
The Minister shall issue the executive decisions necessary for the implementation of the provisions of these regulations.
Article (17)
Publication and Entry into Force
These regulations shall come into force from November 1, 2015, and shall be published in the Official Gazette.

Note
Article (One/5) of Federal Decree-Law No. (26) of 2024 stipulates:
"Federal Law No. (4) of 1984 concerning Missions and Study Aids shall be repealed,"
Article (Two) of the same Decree-Law also stipulates:"
1. Decisions on scholarships and study aids issued based on the provisions of the aforementioned Federal Law No. (4) of 1984 and existing at the time this Decree-Law comes into force shall remain valid as long as they continue to meet the conditions for their continuation.
2. The disbursement of financial allocations for the missions and study aids stipulated in Clause (1) of this Article shall continue in accordance with the decisions in force concerning them, until they are completed or a decision is issued by the Cabinet to terminate them for the public interest.
3. The regulations and decisions issued in implementation of the provisions of Federal Law No. (4) of 1984 shall remain in effect until the work on the scholarship and aid decisions referred to in Clause (1) of this Article is completed or until they are replaced by decisions issued by the Cabinet." Therefore, it was necessary to note.
Note on Name Change:
Article 5/13 of Federal Decree-Law No. (14) of 2016 stipulates that the Ministry of Education shall replace the Ministry of Higher Education and Scientific Research in all legislation related to the competencies set out in Article (8) thereof, and in all rights and obligations, including the rights and obligations contained in any contracts, agreements, or memoranda of understanding concluded by the Ministry.
