قرار رقم (6) لسنة 2025 بشأن تشكيل لجنة خاصة بالنظر في الاستثناءات من قرار حوكمة دراسة التعليم العالي للطلبة المواطنين خارج الدولة
رئيس مجلس التعليم والتنمية البشرية والمجتمع،
-بعد الاطلاع على القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
-وعلى المرسوم بقانون اتحادي رقم (48) لسنة 2021 بشأن التعليم العالي،
-وعلى المرسوم بقانون اتحادي رقم (49) لسنة 2022 بشأن الموارد البشرية في الحكومة الاتحادية،
-وعلى المرسوم بقانون اتحادي رقم (42) لسنة 2024 بشأن إنشاء وتنظيم مجلس التعليم والتنمية البشرية والمجتمع،
-وعلى قرار مجلس الوزراء رقم (48) لسنة 2023 بشأن اللائحة التنفيذية للمرسوم بقانون اتحادي رقم (49) لسنة 2022 بشأن الموارد البشرية في الحكومة الاتحادية،
-وعلى قرار رئيس مجلس التعليم والتنمية البشرية والمجتمع رقم (5) لسنة 2025 بشأن حوكمة دراسة التعليم العالي للطلبة المواطنين خارج الدولة،
-وعلى قرار وزير التعليم العالي والبحث العلمي رقم (93) لسنة 2010 بشأن شروط معادلة الشهادات الخاصة بالطلبة الدارسين خارج الدولة،
-وعلى قرار وزير التعليم العالي والبحث العلمي رقم (34) لسنة 2025 بشأن نظام الاعتراف بمؤهلات التعليم العالي من خارج الدولة،
-وبناءً على ما عرضه الأمين العام للمجلس ومقتضيات المصلحة العامة،
قررنا ما يلي:
المادة (1) تشكيل اللجنة
تشكل لدى مجلس التعليم والتنمية البشرية والمجتمع لجنة خاصة تسمى "لجنة النظر في الاستثناءات من قرار حوكمة دراسة التعليم العالي للطلبة المواطنين خارج الدولة" وترفع توصياتها ونتائج تنفيذ مهامها دورياً إلى رئيس مجلس التعليم والتنمية البشرية والمجتمع.
المادة (2) عضوية اللجنة
أ. يرأس اللجنة ممثل من مجلس التعليم والتنمية البشرية والمجتمع وعضوية ممثلين من الجهات التالية، على ألا يقل التمثيل عن درجة مدير إدارة:
1. وزارة التعليم العالي والبحث العلمي.
2. وزارة الدفاع.
3. وزارة الخارجية.
4. مكتب البعثات الدراسية بديوان الرئاسة.
5. دائرة التعليم والمعرفة - أبو ظبي.
6. هيئة المعرفة والتنمية البشرية - دبي.
ب. لرئيس المجلس ونائبه إضافة أعضاء من جهات ابتعاث أخرى في الدولة في حال دعت الحاجة لذلك.
ج. لرئيس اللجنة دعوة من يراه مناسبًا من الخبراء والمختصين والفنيين من غير أعضائها لحضور الاجتماعات وإبداء الرأي في الأمور المعروضة عليها في حال دعت الحاجة لذلك.
المادة (3) مهام اللجنة
تتولى اللجنة القيام بالمهام الآتية:
أ. تطوير آلية لاستقبال طلبات جهات الابتعاث والطلبة المواطنين الدارسين أو الراغبين بدراسة التعليم العالي خارج الدولة، وذلك للاستثناء من قرار رئيس مجلس التعليم والتنمية البشرية والمجتمع رقم (5) لسنة 2025 بشأن حوكمة دراسة التعليم العالي للطلبة المواطنين خارج الدولة، على أن يتم استقبال الطلبات عن طريق وزارة التعليم العالي والبحث العلمي.
ب. تطوير معايير وإرشادات لاتخاذ توصيات الاستثناء بناءً على اعتبارات خاصة بجهة الابتعاث، أو دولة الابتعاث، أو مؤسسة التعليم العالي، أو نوع التخصص، أو الطالب، أو غيرها من الأسباب المبررة.
ج. النظر في طلبات الاستثناء الواردة إليها ورفع توصياتها متضمنة الأسباب والمبررات إلى رئيس مجلس التعليم والتنمية البشرية والمجتمع الذي يصدر قرار الاستثناء من عدمه.
د. إعداد ورفع تقارير دورية لمخرجات اللجنة إلى رئيس مجلس التعليم والتنمية البشرية والمجتمع تتضمن مستجدات سير العمل والإنجازات وتقييم الأداء والتوصيات والسياسات التطويرية.
هـ. تنفيذ أي مهام إضافية تكلف بها من المجلس أو اللجنة التنفيذية التابعة للمجلس وبما يحقق أهداف اللجنة واختصاصاتها.
المادة (4) آلية انعقاد اللجنة
أ. تجتمع اللجنة بصفة منتظمة مرة واحدة شهريًا على الأقل، أو كلما دعت الحاجة، بناءً على دعوة من رئيسها.
ب. يكون اجتماع اللجنة صحيحًا بحضور أغلبية الأعضاء، وتصدر قراراتها بأغلبية أصوات الحاضرين، على أن يكون لرئيس اللجنة حق الترجيح في حال تساوي الأصوات.
ج. تتولى الأمانة العامة لمجلس التعليم والتنمية البشرية والمجتمع تنظيم أعمال اللجنة، ويحدد رئيس اللجنة مقررًا لها، على ألا يكون له حق في التصويت إلا إذا كان عضوًا أساسيًا في اللجنة، ويتولى المهام التالية:
1. تنظيم الدعوات إلى اجتماعات اللجنة.
2. تحديد جدول اجتماعات اللجنة واعتماده من رئيس اللجنة.
3. تسجيل وتوثيق محاضر اجتماعات اللجنة.
4. متابعة تنفيذ توصيات وقرارات اللجنة.
5. إعداد تقارير دورية عن سير العمل للعرض على رئيس اللجنة.
6. تنسيق التواصل والمراسلات بين أعضاء اللجنة والجهات المختلفة.
7. أي مهام أخرى يكلف بها من رئيس اللجنة.
المادة (5) سريان القرار
يعمل بهذا القرار اعتباراً من تاريخ صدوره، ويبلغ إلى جميع الجهات المعنية لتنفيذه.

Resolution No. (6) of 2025 Concerning the Formation of a Special Committee to Consider Exceptions to the Governance of Higher Education for Citizen Students Abroad
The Chairman of the Education, Human Development, and Community Council,
-Having reviewed Federal Law No. (1) of 1972 concerning the competencies of ministries and the powers of ministers, and its amendments,
-And Federal Decree-Law No. (48) of 2021 concerning Higher Education,
-And Federal Decree-Law No. (49) of 2022 concerning Human Resources in the Federal Government,
-And Federal Decree-Law No. (42) of 2024 concerning the establishment and organization of the Education, Human Development, and Community Council,
-And Cabinet Resolution No. (48) of 2023 concerning the Implementing Regulations of Federal Decree-Law No. (49) of 2022 on Human Resources in the Federal Government,
-And the Resolution of the Chairman of the Education, Human Development, and Community Council No. (5) of 2025 concerning the Governance of Higher Education for Citizen Students Abroad,
-And the Resolution of the Minister of Higher Education and Scientific Research No. (93) of 2010 concerning the conditions for the equivalency of certificates for students studying abroad,
-And the Resolution of the Minister of Higher Education and Scientific Research No. (34) of 2025 concerning the system for the recognition of higher education qualifications from outside the country,
-And based on the proposal of the Secretary-General of the Council and the requirements of the public interest,
We have decided the following:
Article (1) Formation of the Committee
A special committee shall be formed within the Education, Human Development, and Community Council, named the "Committee for Considering Exceptions to the Governance of Higher Education for Citizen Students Abroad," and it shall periodically submit its recommendations and the results of the execution of its tasks to the Chairman of the Education, Human Development, and Community Council.
Article (2) Committee Membership
A. The committee shall be chaired by a representative from the Education, Human Development, and Community Council, with membership from representatives of the following entities, provided that the representation is not below the level of a department director:
1. Ministry of Higher Education and Scientific Research.
2. Ministry of Defence.
3. Ministry of Foreign Affairs.
4. Scholarships Office at the Presidential Court.
5. Department of Education and Knowledge - Abu Dhabi.
6. Knowledge and Human Development Authority - Dubai.
B. The Chairman of the Council and his deputy may add members from other scholarship-granting entities in the country if the need arises.
C. The Chairman of the Committee may invite experts, specialists, and technicians who are not members to attend meetings and provide opinions on the matters presented to it, if the need arises.
Article (3) Committee Tasks
The committee shall undertake the following tasks:
A. Develop a mechanism for receiving applications from scholarship-granting entities and citizen students studying or wishing to study higher education abroad, for exemption from the Resolution of the Chairman of the Education, Human Development, and Community Council No. (5) of 2025 concerning the Governance of Higher Education for Citizen Students Abroad, provided that applications are received through the Ministry of Higher Education and Scientific Research.
B. Develop criteria and guidelines for making exemption recommendations based on special considerations related to the scholarship-granting entity, the country of study, the higher education institution, the type of specialization, the student, or other justified reasons.
C. Review the exemption requests received and submit its recommendations, including reasons and justifications, to the Chairman of the Education, Human Development, and Community Council, who will issue the decision on whether to grant the exemption.
D. Prepare and submit periodic reports on the committee's outcomes to the Chairman of the Education, Human Development, and Community Council, including work progress updates, achievements, performance evaluation, recommendations, and development policies.
E. Carry out any additional tasks assigned to it by the Council or its Executive Committee, in a manner that achieves the committee's objectives and competencies.
Article (4) Committee Meeting Mechanism
A. The committee shall meet regularly at least once a month, or whenever necessary, upon the invitation of its chairman.
B. The committee's meeting shall be valid with the attendance of the majority of its members, and its decisions shall be issued by a majority vote of the attendees. The chairman shall have the casting vote in the event of a tie.
C. The General Secretariat of the Education, Human Development, and Community Council shall organize the committee's work. The committee chairman shall appoint a rapporteur for it, who shall not have the right to vote unless he is a primary member of the committee, and shall undertake the following tasks:
1. Organizing invitations to the committee's meetings.
2. Setting the agenda for the committee's meetings and having it approved by the committee chairman.
3. Recording and documenting the minutes of the committee's meetings.
4. Following up on the implementation of the committee's recommendations and decisions.
5. Preparing periodic reports on work progress for presentation to the committee chairman.
6. Coordinating communication and correspondence between committee members and various entities.
7. Any other tasks assigned by the committee chairman.
Article (5) Entry into Force
This resolution shall come into effect from the date of its issuance, and all concerned authorities shall be notified for its implementation.
