مرسوم أميري رقم (32) لسنة 2005 بإنشاء معهد التكنولوجيا التطبيقية
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي،
بعد الاطلاع على القانون رقم (1) لسنة 1974، بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته،
وبناءً على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه، أصدرنا المرسوم الآتي:
مادة : (1)
ينشأ معهد يسمى (معهد التكنولوجيا التطبيقية) ذو شخصية اعتبارية مستقلة ويتمتع بالاستقلال المالي والإداري، والأهلية القانونية الكاملة لممارسة جميع نشاطاته وتصرفاته، ويكون مملوكًا بالكامل لحكومة أبو ظبي.
مادة (2)
المقر الرئيسي للمعهد، إمارة أبو ظبي ويجوز بقرار من مجلس أمناء المعهد أن ينشئ له فروعًا ومكاتب داخل الإمارة.
مادة (3)
يتولى المعهد القيام بالأعمال التالية:
1- إنشاء معاهد فنية وتقنية ومراكز تدريب في جميع أنحاء الإمارة في التخصصات التي يعتمدها مجلس الأمناء.
2- توفير برامج متخصصة لخريجي معاهد التكنولوجيا التطبيقية في مجالات التكنولوجيا الصناعية.
3- دراسة احتياجات الصناعات القائمة في الدولة والعمل على توفير التخصصات التكنولوجية الملائمة لسد حاجة هذه الصناعات من الكوادر الوطنية.
4- توفير برامج تدريبية متخصصة لتأهيل الكوادر الفنية في الدولة، والتنسيق مع الجهات المختصة في الدولة لتأهيلهم وظيفيًا.
5- توفير الاستشارات الفنية في مجال التأهيل الوظيفي في كافة المجالات التكنولوجية والصناعية والفنية لكافة الجهات في الدولة.
6- إدارة المعاهد الفنية والتقنية ومراكز التدريب في جميع أنحاء الدولة والدخول في الترتيبات اللازمة لتحقيق ذلك.
7- إعداد وتأهيل وتدريب الطلاب والمنتسبين للمعهد للحصول على شهادات علمية وتقنية في التخصصات التي يقرها مجلس الأمناء.
8- إبرام الاتفاقيات الخاصة لتمكين المعهد من تحقيق أهدافه.
9- ما يعهد إليه من أعمال من قبل المجلس التنفيذي.
مادة (4)
1- يتولى إدارة المعهد مجلس أمناء لا يقل عدد أعضائه عن تسعة بمن فيهم رئيس المجلس ونائبه ويصدر بتعيينهم وتحديد مكافآتهم مرسوم أميري، وتكون مدة المجلس خمس سنوات قابلة للتجديد.
2- يكون للمعهد مديرًا عامًا يتم تعيينه وتحديد اختصاصاته وصلاحياته ومكافآته بقرار من مجلس الأمناء.
3- تحدد اللوائح الداخلية للمعهد كيفية اجتماعات مجلس الأمناء والتصويت على قراراته.
مادة : (5)
مجلس الأمناء هو السلطة العليا المنوط بها رسم السياسة العامة للمعهد وتصريف شؤونه ومزاولة جميع الأعمال التي تقتضيها إدارة المعهد، وله على الأخص ما يلي:
1- وضع السياسة العامة والخطط الخاصة بالمعهد ومتابعة تنفيذها وأساليب تطويرها.
2- اعتماد التخصصات والمناهج الدراسية والتدريبية، وإقرار خطط الدراسة والتدريب وتحديد مددها.
3- تشكيل اللجان الاستشارية للتخصصات والمناهج الدراسية والتدريبية.
4- إقرار سياسات القبول ونظم الدراسة والتدريب والامتحانات، ومتطلبات التخرج ومنح الشهادات العلمية والتدريبية وتحديد الرسوم الدراسية.
5- تقييم أداء المدير العام.
6- إصدار اللوائح الداخلية لشؤون المعهد.
7- اعتماد القواعد المالية والتعاقدية الخاصة بشروط تعيين أعضاء هيئة التدريس وغيرهم من الموظفين والعاملين في المعهد واعتماد رواتبهم وعلاواتهم ومكافآتهم وغيرها من الشؤون الوظيفية.
8- إقرار الاتفاقيات الخاصة التي يعقدها المعهد مع أي طرف آخر.
9- إقرار مشروع الميزانية السنوية للمعهد ورفعها للمجلس التنفيذي لاعتمادها.
10- إقرار الحساب الختامي للمعهد.
11- الموضوعات التي يحيلها إليه المجلس التنفيذي.
ويجوز لمجلس الأمناء تفويض بعض اختصاصاته للمدير العام.
مادة (6)
للمعهد ميزانية مستقلة يتم تمويلها على النحو الآتي:
( أ ) الاعتمادات السنوية المخصصة للمعهد من قبل المجلس التنفيذي.
(ب) الوفر المتحقق من ميزانية المعهد عن السنوات السابقة ما لم يقرر المجلس التنفيذي خلاف ذلك.
(ج) ريع أموال المعهد الثابتة والمنقولة.
(د) الرسوم الدراسية التي تفرض بقرار من مجلس الأمناء.
(هـ) الهبات والوصايا والإعانات والإيرادات الأخرى التي يقرر مجلس الأمناء قبولها.
مادة : (7)
يجوز لمجلس الأمناء أن يعين مدققًا حسابيًا أو أكثر لمراجعة حسابات المعهد، ويحدد المجلس مكافآته السنوية.
مادة (8)
يلتزم المعهد في الصرف باللوائح المالية والحسابية المعتمدة من مجلس الأمناء.
مادة (9)
يُعفى المعهد من كافة الضرائب والرسوم المحلية.
مادة (10)
يُنشر هذا المرسوم في الجريدة الرسمية، ويُعمل به اعتبارًا من تاريخ نشره.

Emiri Decree No. (32) of 2005 on the Establishment of the Institute of Applied Technology
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi,
Having reviewed Law No. (1) of 1974, regarding the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments,
And based on what was presented to the Executive Council, and its approval thereof, we have issued the following decree:
Article: (1)
An institute named (the Institute of Applied Technology) shall be established, having an independent legal personality and enjoying financial and administrative independence, and full legal capacity to carry out all its activities and actions, and it shall be wholly owned by the Government of Abu Dhabi.
Article (2)
The main headquarters of the Institute shall be in the Emirate of Abu Dhabi. The Board of Trustees of the Institute may, by its decision, establish branches and offices for it within the Emirate.
Article (3)
The Institute shall undertake the following tasks:
1- Establishing technical and vocational institutes and training centers throughout the Emirate in the specializations approved by the Board of Trustees.
2- Providing specialized programs for graduates of the Institute of Applied Technology in the fields of industrial technology.
3- Studying the needs of existing industries in the state and working to provide suitable technological specializations to meet the needs of these industries for national cadres.
4- Providing specialized training programs to qualify technical cadres in the state, and coordinating with the competent authorities in the state for their professional qualification.
5- Providing technical consultations in the field of professional qualification in all technological, industrial, and technical fields to all entities in the state.
6- Managing technical and vocational institutes and training centers throughout the state and entering into the necessary arrangements to achieve this.
7- Preparing, qualifying, and training students and affiliates of the Institute to obtain scientific and technical certificates in the specializations approved by the Board of Trustees.
8- Concluding special agreements to enable the Institute to achieve its objectives.
9- Any other tasks assigned to it by the Executive Council.
Article (4)
1- The Institute shall be managed by a Board of Trustees with no fewer than nine members, including the Chairman and Vice-Chairman. Their appointment and remuneration shall be issued by an Emiri decree, and the term of the Board shall be five years, renewable.
2- The Institute shall have a Director-General who shall be appointed, and whose responsibilities, powers, and remuneration shall be determined by a decision of the Board of Trustees.
3- The internal regulations of the Institute shall determine the procedures for the meetings of the Board of Trustees and voting on its decisions.
Article: (5)
The Board of Trustees is the supreme authority entrusted with drawing up the general policy of the Institute, managing its affairs, and carrying out all the work required for the management of the Institute. It shall have, in particular, the following:
1- Setting the general policy and plans for the Institute and following up on their implementation and methods of development.
2- Approving specializations, academic and training curricula, and endorsing study and training plans and determining their durations.
3- Forming advisory committees for specializations and academic and training curricula.
4- Approving admission policies, study and training systems, examinations, graduation requirements, awarding academic and training certificates, and setting tuition fees.
5- Evaluating the performance of the Director-General.
6- Issuing the internal regulations for the Institute's affairs.
7- Approving the financial and contractual rules related to the appointment conditions of faculty members and other employees and workers in the Institute, and approving their salaries, allowances, bonuses, and other employment-related matters.
8- Approving special agreements concluded by the Institute with any other party.
9- Approving the draft annual budget of the Institute and submitting it to the Executive Council for adoption.
10- Approving the final account of the Institute.
11- Matters referred to it by the Executive Council.
The Board of Trustees may delegate some of its powers to the Director-General.
Article (6)
The Institute shall have an independent budget, which shall be financed as follows:
(a) The annual appropriations allocated to the Institute by the Executive Council.
(b) The surplus realized from the Institute's budget from previous years, unless the Executive Council decides otherwise.
(c) The proceeds from the Institute's fixed and movable assets.
(d) Tuition fees imposed by a decision of the Board of Trustees.
(e) Donations, bequests, grants, and other revenues that the Board of Trustees decides to accept.
Article: (7)
The Board of Trustees may appoint one or more auditors to review the Institute's accounts, and the Board shall determine their annual remuneration.
Article (8)
The Institute shall adhere to the financial and accounting regulations approved by the Board of Trustees in its expenditures.
Article (9)
The Institute shall be exempt from all local taxes and fees.
Article (10)
This decree shall be published in the Official Gazette and shall come into effect from the date of its publication.
