قانون رقم (7) لسنة 2013 في شأن إنشاء أكاديمية ربدان
- نحن خليفة بن زايد آل نهيان، حاكم أبوظبي.
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي والقوانين المعدلة له.
- وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني والقوانين المعدلة له.
- وعلى القانون الاتحادي رقم (4) لسنة 1992 في شأن تنظيم وزارة التعليم العالي والبحث العلمي.
- وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.
- أصدرنا القانون الآتي:
مادة (1)
في تطبيق أحكام هذا القانون، يقصد بالكلمات والعبارات الآتية المعاني الموضحة قرين كل منها، ما لم يقض سياق النص بغير ذلك.
الدولة: الإمارات العربية المتحدة.
الإمارة: إمارة أبو ظبي.
المجلس التنفيذي: المجلس التنفيذي للإمارة.
الأكاديمية: أكاديمية ربدان.
مجلس الأمناء: مجلس أمناء الأكاديمية.
الجهات المعنية: الجهات الحكومية الاتحادية والمحلية وشبه الحكومية والخاصة المشاركة في نشاطات الأكاديمية داخل الإمارة وخارجها.
الجهات المستفيدة: الجهات الحكومية وشبه الحكومية والخاصة وأفراد المجتمع المستفيدة من أنشطة الأكاديمية.
الشهادة الدراسية المعتمدة: الدبلوم، والدبلوم العالي، والبكالوريوس، والماجستير، والدكتوراة، وشهادات التعليم المهني والتدريب وذلك بما يتوافق مع مسميات المنظومة الوطنية للمؤهلات ومستوياتها.
برامج الأكاديمية: برامج التعليم الأكاديمي والتدريب التقني والمهني المشتركة والمتخصصة في مجالات السلامة والأمن والدفاع والتأهب لحالات الطوارئ وإدارة الأزمات.
المجلس العلمي: المجلس العلمي للأكاديمية.
مادة (2)
تنشأ أكاديمية ذات شخصية اعتبارية مستقلة تسمى "أكاديمية ربدان" تتمتع بالاستقلال المالي والإداري، ولها الأهلية القانونية الكاملة لممارسة أعمالها وتحقيق أهدافها، وتتبع المجلس التنفيذي.
مادة (3)
مقر الأكاديمية مدينة أبو ظبي، ويجوز بقرار من مجلس الأمناء إنشاء فروع أو مكاتب لها داخل الإمارة وخارجها.
مادة (4)
تهدف الأكاديمية إلى أن تكون رافدًا أساسيًا لقيادات المستقبل، ومركزا وطنيًا متميزا لتأهيل وتطوير الكوادر في مجالات السلامة والأمن والدفاع والتأهب لحالات الطوارئ وإدارة الأزمات، وذلك على أسس من المنهجية العلمية لتحقيق استجابة موحدة ومتكاملة وفعالة للتعامل مع جميع أنواع التهديدات والمخاطر والحوادث والأزمات المتوقعة بكفاءة عالية، وغرس مبادئ التعليم المستدام، وذلك لتعزيز كفاءة الجهات المعنية.
مادة (5)
تختص الأكاديمية (1) في سبيل تحقيق أهدافها بالآتي:
1- إرساء نظام أكاديمي وتدريبي متميز من خلال تطوير وتنفيذ برامج الأكاديمية وفق أفضل وأحدث الأساليب والمناهج العالمية في مجالات السلامة والأمن والدفاع والتأهب لحالات الطوارئ وإدارة الأزمات.
2- إعداد برامج الأكاديمية والأنشطة العلمية والتدريبية المتخصصة لتلبية احتياجات الجهات المستفيدة من الكوادر العلمية المؤهلة ذات الكفاءة العالية.
3- إعداد الكوادر العلمية والتدريبية وورش العمل المتخصصة والمؤتمرات والندوات في مجالات برامج الأكاديمية.
4- تقديم الخدمات الاستشارية والفنية للجهات المعنية والمستفيدة من برامج الأكاديمية.
5- تنمية الشراكات الأكاديمية والعلمية والعملية، بالتعاون مع الجهات العاملة في مجالات برامج الأكاديمية داخل الدولة وخارجها، وكذلك مع الجهات المعنية والمستفيدة بغية تبادل الخبرات في سبيل الوصول إلى تنمية أكاديمية وعلمية مستدامة في مجالات برامج الأكاديمية.
6- إنشاء وتطوير قاعدة بيانات حديثة لتكون مرجعا للمختصين في مجالات برامج الأكاديمية.
7- أية اختصاصات أخرى تعهد إليها من المجلس التنفيذي.
مادة (6)
- يكون للأكاديمية مجلس أمناء يتكون من رئيس ونائب رئيس وعدد من الأعضاء لا يزيد على تسعة يصدر بتشكيله قرار من رئيس المجلس التنفيذي.
- مدة العضوية في مجلس الأمناء ثلاث سنوات قابلة للتجديد.
- يصدر مجلس الأمناء النظام الداخلي الخاص به والذي يتضمن إجراءات انعقاده وكيفية التصويت على قراراته.
مادة (7)
يتولى مجلس الأمناء ممارسة جميع الصلاحيات اللازمة لتسيير العمل بالأكاديمية، والإشراف على إدارة شؤونها وتحقيق أهدافها، ويكون له بوجه خاص ما يأتي:
1 - رسم الخطط الاستراتيجية للأكاديمية.
2- وضع السياسات العامة للأكاديمية والأهداف السنوية ومتابعة تنفيذها تلبية لاحتياجات الدولة والإمارة.
3- إصدار النظم واللوائح اللازمة لتسيير عمل الأكاديمية وذلك بعد موافقة المجلس التنفيذي.
-4- إقرار خطط وبرامج ومشروعات الأكاديمية، ومتابعة تنفيذها.
-5- إقرار الميزانية السنوية للأكاديمية والحساب الختامي تمهيدًا لاعتمادهما من المجلس التنفيذي.
6- دراسة التقارير الدورية المرفوعة من رئيس الأكاديمية حول أداء وإنجازات واحتياجات الأكاديمية.
7- تشكيل لجان تنفيذية واستشارية دائمة أو مؤقتة لتنفيذ مهام واختصاصات محددة، ويجوز له أن يشكل لجانًا مشتركة مع المجلس العلمي.
8- دعم الأكاديمية في التواصل والتفاعل مع الجهات المعنية.
9- إصدار القرارات اللازمة لتفعيل دور الأكاديمية مع الجهات المعنية.
مادة (8)
يكون للأكاديمية مجلس علمي يشكل بقرار من مجلس الأمناء لا يقل عدد أعضاءه عن تسعة ولا يزيد على اثني عشر عضوا ويعقد اجتماعاته وفق نظم ولوائح الأكاديمية، ويمارس الصلاحيات والاختصاصات المتعلقة بتنظيم ومتابعة البرامج الأكاديمية وخطط البحث العلمي والبرامج الثقافية في الأكاديمية ومدى فاعليتها ورفع توصياته في هذا الشأن لمجلس الأمناء لاعتمادها.
مادة (9)
- يكون للأكاديمية رئيس ونائب رئيس يصدر بتعيينهما قرار من رئيس المجلس التنفيذي.
- يمارس رئيس الأكاديمية الصلاحيات الآتية:
1- تنفيذ قرارات مجلس الأمناء.
2- تنفيذ الخطط الاستراتيجية للأكاديمية وفق ما انتهى إليه مجلس الأمناء.
3- إعداد اللوائح اللازمة لتنظيم سير العمل في الأكاديمية، ورفعها إلى مجلس الأمناء لإقرارها.
-4- تعيين موظفي الأكاديمية وفق نظم ولوائح الموارد البشرية المعمول بها في الأكاديمية.
-5- إعداد مشروع الميزانية السنوية والحساب الختامي، ورفعهما إلى مجلس الأمناء.
6- رفع التقارير الدورية عن سير العمل في الأكاديمية إلى مجلس الأمناء.
7- تمثيل الأكاديمية أمام القضاء والغير.
8- إبرام الاتفاقيات وتوقيع العقود اللازمة لتحقيق أهدافها وذلك بعد اعتمادها من قبل مجلس الأمناء.
9- أية اختصاصات أخرى يكلف بها من قبل مجلس الأمناء.
- يحل نائب رئيس الأكاديمية محل رئيس الأكاديمية حال غيابه.
- لرئيس الأكاديمية أن يفوض أيًا من صلاحياته إلى نائبه أو أي من كبار موظفي الأكاديمية.
مادة (10)
يمنح الطالب - بعد اجتيازه بنجاح متطلبات الدراسة - الشهادة الدراسية المعتمدة في أحد البرامج الأكاديمية بعد اعتمادها من الجهات المختصة وفقًا للتشريعات السارية.
مادة (11)
لا يجوز أن يكون لرئيس أو نائب رئيس مجلس الأمناء أو لأي عضو من أعضائه، أو لرئيس الأكاديمية أو نائبه أو أحد موظفي الأكاديمية مصلحة شخصية مباشرة أو غير مباشرة في العقود التي تبرم مع الأكاديمية أو لحسابها، أو في الأعمال والمشاريع التي تقوم بها.
مادة (12)
يكون للأكاديمية ميزانية مستقلة، وتتكون مواردها من الآتي:
1- الاعتمادات السنوية المخصصة لها من المجلس التنفيذي.
2- الرسوم الدراسية وأي رسوم أخرى مستوفاة مقابل الخدمات التي تقدمها الأكاديمية.
3- عائد أموال الأكاديمية العقارية والمنقولة.
4- الهبات والتبرعات والوصايا والمنح والإعانات التي يقرها مجلس الأمناء.
مادة (13)
1- يعين مجلس الأمناء مصرفًا أو أكثر من المصارف الوطنية العاملة في الدولة لإيداع مخصصات وأموال الأكاديمية، وتحدد نظم ولوائح الأكاديمية شروط وصلاحيات إدارة وتشغيل حسابات الأكاديمية المصرفية بما في ذلك الأشخاص المخولين بذلك ونظم مواجهة المصروفات الطارئة.
2- يعين مجلس الأمناء مدقق حسابات خارجي أو أكثر لمراجعة حسابات الأكاديمية، ويحدد القرار مدة تعيينه وأتعابه.
3- يعد مجلس أمناء في نهاية كل سنة مالية تقريرًا عن نشاطها ومركزها المالي، ويضمنه اقتراحاته وتوصياته، ويرفعه إلى المجلس التنفيذي لاعتماده.
مادة (14)
تبدأ السنة المالية للأكاديمية في أول شهر يناير وتنتهي في آخر ديسمبر من كل عام، باستثناء السنة المالية الأولى فتبدأ من تاريخ العمل بأحكام هذا القانون وتنتهي بنهاية شهر ديسمبر من السنة التالية.
مادة (15)
- تسري على الأكاديمية قواعد ونظم الخدمة المدنية والنظام المالي والمشتريات المعمول بها في الإمارة لحين صدور القواعد الخاصة بالأكاديمية في هذا الشأن.
- يسري على موظفي الأكاديمية من المواطنين قانون معاشات ومكافآت التقاعد المدنية المعمول به في الإمارة.
مادة (16)
تعفى الأكاديمية من كافة الضرائب والرسوم المحلية.
مادة (17)
يصدر مجلس الأمناء اللائحة التنفيذية اللازمة لتنفيذ أحكام هذا القانون بعد موافقة المجلس التنفيذي.
مادة (18)
يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
مادة (19)
ينشر هذا القانون في الجريدة الرسمية ويعمل به من تاريخ صدوره.

- We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi.
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws.
- And Law No. (2) of 1971 concerning the National Consultative Council and its amending laws.
- And Federal Law No. (4) of 1992 concerning the organization of the Ministry of Higher Education and Scientific Research.
- And based on what was presented to the Executive Council, and its approval thereof.
- We have issued the following Law:
Article (1)
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each of them, unless the context otherwise requires.
The State: The United Arab Emirates.
The Emirate: The Emirate of Abu Dhabi.
The Executive Council: The Executive Council of the Emirate.
The Academy: Rabdan Academy.
The Board of Trustees: The Board of Trustees of the Academy.
Concerned Entities: Federal, local, semi-governmental, and private entities participating in the Academy's activities inside and outside the Emirate.
Beneficiary Entities: Governmental, semi-governmental, private entities, and community members benefiting from the Academy's activities.
Accredited Academic Certificate: Diploma, Higher Diploma, Bachelor's, Master's, Doctorate, and vocational education and training certificates, in accordance with the designations and levels of the National Qualifications Framework.
Academy Programs: Joint and specialized academic education, technical, and vocational training programs in the fields of safety, security, defense, emergency preparedness, and crisis management.
The Academic Council: The Academic Council of the Academy.
Article (2)
An academy with an independent legal personality called "Rabdan Academy" shall be established, enjoying financial and administrative independence, and having full legal capacity to conduct its business and achieve its objectives. It shall report to the Executive Council.
Article (3)
The headquarters of the Academy shall be in the city of Abu Dhabi, and by a decision of the Board of Trustees, it may establish branches or offices inside and outside the Emirate.
Article (4)
The Academy aims to be a primary resource for future leaders and a distinguished national center for qualifying and developing cadres in the fields of safety, security, defense, emergency preparedness, and crisis management, based on a scientific methodology to achieve a unified, integrated, and effective response to all types of threats, risks, incidents, and crises with high efficiency, and to instill the principles of sustainable education, in order to enhance the efficiency of the concerned entities.
Article (5)
To achieve its objectives, the Academy shall be competent to (1) do the following:
1- Establish a distinguished academic and training system by developing and implementing the Academy's programs according to the best and latest international methods and curricula in the fields of safety, security, defense, emergency preparedness, and crisis management.
2- Prepare the Academy's programs and specialized scientific and training activities to meet the needs of beneficiary entities for highly competent and qualified scientific cadres.
3- Prepare scientific and training cadres and organize specialized workshops, conferences, and seminars in the fields of the Academy's programs.
4- Provide advisory and technical services to concerned and beneficiary entities of the Academy's programs.
5- Develop academic, scientific, and practical partnerships, in cooperation with entities working in the fields of the Academy's programs inside and outside the State, as well as with concerned and beneficiary entities, to exchange expertise in order to achieve sustainable academic and scientific development in the fields of the Academy's programs.
6- Establish and develop a modern database to serve as a reference for specialists in the fields of the Academy's programs.
7- Any other competencies assigned to it by the Executive Council.
Article (6)
- The Academy shall have a Board of Trustees consisting of a Chairman, a Vice-Chairman, and a number of members not exceeding nine, whose formation shall be issued by a decision of the Chairman of the Executive Council.
- The term of membership in the Board of Trustees is three years, renewable.
- The Board of Trustees shall issue its own internal regulations, which shall include its meeting procedures and how to vote on its decisions.
Article (7)
The Board of Trustees shall exercise all necessary powers to manage the work of the Academy, supervise its affairs, and achieve its objectives. In particular, it shall have the following:
1 - Formulate the strategic plans of the Academy.
2- Set the general policies of the Academy and its annual objectives, and follow up on their implementation to meet the needs of the State and the Emirate.
3- Issue the necessary systems and regulations for the operation of the Academy after the approval of the Executive Council.
-4- Approve the plans, programs, and projects of the Academy, and follow up on their implementation.
-5- Approve the annual budget of the Academy and the final account in preparation for their adoption by the Executive Council.
6- Study the periodic reports submitted by the President of the Academy on the performance, achievements, and needs of the Academy.
7- Form permanent or temporary executive and advisory committees to carry out specific tasks and competencies, and it may form joint committees with the Academic Council.
8- Support the Academy in communicating and interacting with concerned entities.
9- Issue the necessary decisions to activate the role of the Academy with the concerned entities.
Article (8)
The Academy shall have an Academic Council, formed by a decision of the Board of Trustees, with no less than nine and no more than twelve members. It shall hold its meetings in accordance with the Academy's systems and regulations, and shall exercise the powers and competencies related to organizing and following up on academic programs, scientific research plans, and cultural programs at the Academy, their effectiveness, and submitting its recommendations in this regard to the Board of Trustees for approval.
Article (9)
- The Academy shall have a President and a Vice President, who shall be appointed by a decision of the Chairman of the Executive Council.
- The President of the Academy shall exercise the following powers:
1- Implementing the decisions of the Board of Trustees.
2- Implementing the strategic plans of the Academy as decided by the Board of Trustees.
3- Preparing the necessary regulations to organize the work in the Academy, and submitting them to the Board of Trustees for approval.
-4- Appointing the Academy's employees in accordance with the human resources systems and regulations in force at the Academy.
-5- Preparing the draft annual budget and the final account, and submitting them to the Board of Trustees.
6- Submitting periodic reports on the progress of work at the Academy to the Board of Trustees.
7- Representing the Academy before the judiciary and others.
8- Concluding agreements and signing contracts necessary to achieve its objectives after their approval by the Board of Trustees.
9- Any other competencies assigned to him by the Board of Trustees.
- The Vice President of the Academy shall replace the President of the Academy in his absence.
- The President of the Academy may delegate any of his powers to his Vice President or any of the senior employees of the Academy.
Article (10)
The student shall be awarded - after successfully passing the study requirements - the Accredited Academic Certificate in one of the academic programs after its accreditation by the competent authorities in accordance with the applicable legislation.
Article (11)
The Chairman or Vice-Chairman of the Board of Trustees, any of its members, the President of the Academy, his Vice President, or any of the Academy's employees may not have a direct or indirect personal interest in the contracts concluded with or for the account of the Academy, or in the works and projects it undertakes.
Article (12)
The Academy shall have an independent budget, and its resources shall consist of the following:
1- The annual appropriations allocated to it by the Executive Council.
2- Tuition fees and any other fees collected in exchange for the services provided by the Academy.
3- The revenue from the Academy's real estate and movable property.
4- Gifts, donations, bequests, grants, and subsidies approved by the Board of Trustees.
Article (13)
1- The Board of Trustees shall appoint one or more national banks operating in the State to deposit the Academy's allocations and funds. The Academy's systems and regulations shall specify the conditions and powers for managing and operating the Academy's bank accounts, including the authorized persons and systems for dealing with incidental expenses.
2- The Board of Trustees shall appoint one or more external auditors to audit the Academy's accounts, and the decision shall specify the term of their appointment and their fees.
3- At the end of each fiscal year, the Board of Trustees shall prepare a report on its activity and financial position, including its proposals and recommendations, and submit it to the Executive Council for approval.
Article (14)
The fiscal year of the Academy shall begin on the first of January and end on the last of December of each year, with the exception of the first fiscal year, which shall begin from the date this Law comes into force and end at the end of December of the following year.
Article (15)
- The civil service rules and regulations, and the financial and procurement system in force in the Emirate shall apply to the Academy until the issuance of the Academy's own rules in this regard.
- The civil pensions and gratuities law in force in the Emirate shall apply to the national employees of the Academy.
Article (16)
The Academy shall be exempt from all local taxes and fees.
Article (17)
The Board of Trustees shall issue the necessary executive regulations for the implementation of the provisions of this Law after the approval of the Executive Council.
Article (18)
Any text or provision that contradicts or conflicts with the provisions of this Law shall be repealed.
Article (19)
This Law shall be published in the Official Gazette and shall come into force from the date of its issuance.
