قانون رقم (5) لسنة 2017 بإنشاء جامعة خليفة للعلوم والتكنولوجيا
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي.
* بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي والقوانين المعدلة له.
وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني والقوانين المعدلة له.
وعلى القانون رقم (9) لسنة 2000 بتأسيس المعهد البترولي.
* وعلى القانون رقم (3) لسنة 2007 بإنشاء جامعة خليفة للعلوم والتكنولوجيا والبحوث المعدل بالقانون رقم (29) لسنة 2007.
* وعلى القانون رقم (22) لسنة 2007 في شأن تأسيس شركة أبو ظبي لطاقة المستقبل (شركة مساهمة خاصة) وإنشاء معهد مصدر للعلوم والتكنولوجيا.
* وعلى القانون رقم (8) لسنة 2008 بإعادة تنظيم مجلس أبوظبي للتعليم.
وعلى القانون رقم (6) لسنة 2016 بشأن الموارد البشرية في إمارة أبو ظبي.
* وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، والقوانين المعدلة له.
وعلى المرسوم بقانون اتحادي (1) لسنة 2010 في شأن إنشاء وتنظيم الهيئة الوطنية للمؤهلات.
* وبناءً على ما عرض على المجلس التنفيذي، وموافقة الدائرة عليه.
* أصدرنا القانون الآتي:
مادة (1)
في تطبيق أحكام هذا القانون، يقصد بالكلمات والعبارات التالية المعاني المبينة قرين كل منها، ما لم يقض سياق النص بغير ذلك:
الدولة: الإمارات العربية المتحدة.
الإمارة: إمارة أبو ظبي.
المجلس التنفيذي: المجلس التنفيذي للإمارة.
الدائرة: دائرة التعليم والمعرفة.
الجهات المختصة: وزارة التربية والتعليم والهيئة الوطنية للمؤهلات والدائرة وأية جهة أخرى ذات علاقة بالتعليم العالي والبحث العلمي.
الجامعة: جامعة خليفة للعلوم والتكنولوجيا.
مجلس الأمناء: مجلس أمناء الجامعة.
الرئيس: رئيس الجامعة.
برامج التعليم العالي: البرامج الأكاديمية المعتمدة من مستوى البكالوريوس وحتى الدكتوراه وغيرها من الشهادات الأكاديمية، وبرامج التعليم المستمر التي يقرها مجلس الأمناء.
مادة (2)
الأحكام القضائية المرتبطة
* تنشأ بموجب أحكام هذا القانون جامعة تسمى "جامعة خليفة للعلوم والتكنولوجيا" تكون لها الشخصية الاعتبارية والأهلية القانونية الكاملة للتصرف، وتتمتع بالاستقلال المالي والإداري في جميع شؤونها، وتتبع المجلس التنفيذي.
* تحل الجامعة محل كل من جامعة خليفة للعلوم والتكنولوجيا والبحوث، والمعهد البترولي، ومعهد مصدر للعلوم والتكنولوجيا، وتنقل للجامعة كافة الحقوق والالتزامات والأصول والموجودات والأموال المتعلقة بتلك الجهات.
مادة (3)
مقر الجامعة الرئيسي مدينة أبو ظبي ويجوز بقرار من مجلس الأمناء فتح فروع لها داخل الإمارة أو خارجها بعد موافقة المجلس التنفيذي.
مادة (4)
تهدف الجامعة إلى دعم مسيرة التنمية والتطوير والبحث العلمي عن طريق طرح برامج التعليم العالي وإجراء البحوث العلمية بما يحقق التميز الأكاديمي والبحثي على الصعيد المحلي والإقليمي والدولي، ورفد المجتمع بالكوادر المؤهلة وذلك وفق التشريعات السارية، ولها في سبيل ذلك القيام بالآتي:
- توثيق الروابط الثقافية والعلمية من خلال إبرام اتفاقيات التعاون والتبادل العلمي مع المؤسسات الأكاديمية والعلمية المتميزة داخل الدولة وخارجها.
- إيجاد الصلة بين الفكر الأكاديمي ومؤسسات المجتمع، وخلق النفع المتبادل في هذا المجال.
- تشجيع ودعم ورعاية أنشطة الأبحاث العلمية وبرامج نقل المعرفة والتكنولوجيا الحديثة.
- إعداد وتدريب الكوادر المؤهلة علميًا وعمليا في كافة جوانب العلوم والمعرفة من خلال تنظيم وتنفيذ برامج تعليمية وتدريبية متطورة بأعلى درجات التقنية والحرفية.
- تقديم البحوث الأكاديمية والتطبيقية في المجالات ذات الأهمية العلمية والاستراتيجية.
- تشجيع ثقافة وتطبيقات ومشاريع الابتكار وريادة الأعمال.
- تقديم الاستشارات والمعلومات والخدمات في كافة المجالات الأكاديمية والعلمية والإدارية وتنظيم الندوات والمؤتمرات والدورات التدريبية بما يسهم في خدمة كافة قطاعات المجتمع.
- أية اختصاصات أخرى تكلف بها من المجلس التنفيذي.
مادة (5)
يكون للجامعة مجلس أمناء لا يقل عن خمسة أعضاء بمن فيهم رئيس مجلس الأمناء ونائبه، ويصدر بتعيينهم وتحديد مكافأتهم قرار من رئيس المجلس التنفيذي.
* تكون مدة عضوية مجلس الأمناء ثلاث سنوات قابلة للتجديد.
مادة (6)

* يختص مجلس الأمناء بالآتي:
- اعتماد السياسة العامة والخطط الاستراتيجية للجامعة، ومتابعة تنفيذها.
- تشكيل اللجان الاستشارية للتخصصات والمناهج الدراسية والتدريبية.
- إقرار التخصصات والمناهج والبرامج الدراسية والتدريبية وخطط الدراسة والتدريب وتحديد مدتها بالتنسيق مع الجهات المختصة.
- منح الدرجات والشهادات العلمية المعتمدة وفقًا للأنظمة المتبعة وإقرار سياسات القبول ونظم الدراسة والتدريب والامتحانات ومتطلبات التخرج.
- إقرار المقترحات الخاصة بالربط بين استراتيجية الجامعة والمؤسسات الاقتصادية والصناعية.
- إصدار اللوائح والسياسات الأكاديمية والفنية.
- إصدار اللوائح الداخلية للجامعة بما في ذلك اللوائح المالية والإدارية والموارد البشرية بعد موافقة المجلس التنفيذي.
- إصدار اللائحة الداخلية المنظمة لاجتماعاته وإجراءات انعقاده وكيفية التصويت على قراراته.
- تشكيل اللجان إذا اقتضت الحاجة، وله تفويض أي من صلاحياته إلى تلك اللجان.
- اقتراح مشروع الموازنة السنوية للجامعة، ورفعها إلى المجلس التنفيذي وفق النظم المتبعة.
- تحديد الرسوم الجامعية والمكافآت المالية للطلبة.
- إصدار الهيكل التنظيمي للجامعة.
- وضع أسس ومعايير مراقبة جودة التعليم وتطبيق أعلى مستوياتها في الجامعة.
- مراجعة التقارير الدورية عن أداء الجامعة.
- اعتماد الاتفاقيات التعليمية التي تبرمها الجامعة داخل الإمارة أو خارجها.
- إنشاء مراكز للتعليم المستمر تكون مرتبطة ماليا وإداريا بالجامعة.
- تأسيس صناديق الوقف لمصلحة أهداف الجامعة وغاياتها.
- الاقتراض وفق التشريعات السارية.
- تأسيس الشركات أو المساهمة فيها المرتبطة باختصاصات الجامعة، ورفع تقارير بشأن تلك الشركات وأدائها إلى الدائرة.
- الدخول في شراكات تندرج تحت اختصاص الجامعة.
- الموافقة على تنفيذ الاستراتيجيات المتعلقة بالأنشطة التجارية والملكية الفكرية الناشئة نتيجة أبحاث الجامعة وعمليات تعاون الجامعة مع الغير.
* لمجلس الأمناء تفويض بعض اختصاصاته إلى الرئيس أو لأي من أعضاء مجلس الأمناء.
مادة (7)
* يكون للجامعة رئيس يصدر بتعيينه وتحديد مخصصاته قرار من رئيس المجلس التنفيذي بناء على توصية مجلس الأمناء ويتولى تسيير العمل اليومي للجامعة، وله على وجه الخصوص ما يأتي:
- اقتراح الخطط اللازمة لتنفيذ السياسة العامة للجامعة واستراتيجيتها ورفعها إلى مجلس الأمناء للاعتماد.
- رفع البرامج والخطط الأكاديمية والإدارية التي تساهم في تنفيذ أهداف الجامعة إلى مجلس الأمناء.
- إعداد مشروع الموازنة السنوية والحساب الختامي للجامعة ورفعهما لمجلس الأمناء.
- اقتراح اللوائح والسياسات الأكاديمية والفنية.
- اقتراح اللوائح الداخلية والأنظمة المتعلقة بالشؤون المالية والإدارية والموارد البشرية والهيكل التنظيمي للجامعة ورفعها إلى مجلس الأمناء.
- إعداد تقارير دورية عن سير العمل في الجامعة ورفعها إلى مجلس الأمناء.
- تمثيل الجامعة أمام القضاء أو الغير.
- إدارة شؤون الجامعة العلمية والمالية والإدارية وفق أحكام هذا القانون والأنظمة والقرارات الصادرة تنفيذا له.
- تقديم خطة العمل السنوية للجامعة ورفعها إلى مجلس الأمناء.
- أية اختصاصات أخرى يكلف بها من مجلس الأمناء.
* لرئيس الجامعة تفويض بعض اختصاصاته إلى كبار موظفي الجامعة.
مادة (8)
تتكون الموارد المالية للجامعة من الآتي:
- الاعتمادات السنوية المخصصة لها من حكومة أبوظبي.
- الرسوم الجامعية.
- عائد استثمارات أموالها المنقولة وغير المنقولة.
- الهبات والإعانات والمنح والإيرادات الأخرى التي تتفق مع أهداف الجامعة ويقرها مجلس الأمناء.
- الدعم المالي المقدم من القطاع العام أو من شركات ومؤسسات القطاع الخاص وأفراد ومؤسسات تمويل البحث العلمي المختلفة والذي يخصص لتمويل أبحاث أو أنشطة معينة ويصرف حسب أوجه الصرف المخصصة له، وخارج الموازنة المعتمدة من الجامعة.
مادة (9)
تبدأ السنة المالية للجامعة في أول يناير وتنتهي في 31 ديسمبر من كل عام باستثناء السنة المالية الأولى فتبدأ من تاريخ العمل بهذا القانون وتنتهي في آخر ديسمبر من العام التالي.
مادة (10)
يعين مجلس الأمناء مدقق حسابات قانوني أو أكثر من المدققين المعتمدين لمراجعة وتدقيق كافة حسابات الجامعة، ويرفع تقريرًا سنويًا بنتيجة عمله إلى مجلس الأمناء ونسخة منه إلى الدائرة.
مادة (11)
ينقل إلى الجامعة أعضاء الهيئة الأكاديمية والإدارية والعاملين في جامعة خليفة للعلوم والتكنولوجيا والبحوث والمعهد البترولي ومعهد مصدر للعلوم والتكنولوجيا.
مادة (12)
الأحكام القضائية المرتبطة
يستمر العمل باللوائح والأنظمة والعقود الحالية للموظفين العاملين في جامعة خليفة للعلوم والتكنولوجيا والبحوث والمعهد البترولي ومعهد مصدر للعلوم والتكنولوجيا المنقولين من كل منها إلى حين اعتماد مجلس الأمناء للوائح وسياسات الموارد البشرية وعقود التوظيف المعمول بها في الجامعة.
مادة (13)
يلغى القانون رقم (9) لسنة 2000 والقانون رقم (3) لسنة 2007 المشار إليهما.
* يلغى من القانون رقم (22) لسنة 2007 المشار إليه كل ما يخص معهد مصدر للعلوم والتكنولوجيا.
* يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
مادة (14)
ينفذ هذا القانون من تاريخ صدوره، وينشر في الجريدة الرسمية.

Law No. (5) of 2017 on the Establishment of Khalifa University of Science and Technology
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi.
* Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws.
And Law No. (2) of 1971 Concerning the National Consultative Council and its amending laws.
And Law No. (9) of 2000 on the Establishment of the Petroleum Institute.
* And Law No. (3) of 2007 on the Establishment of Khalifa University of Science, Technology and Research, as amended by Law No. (29) of 2007.
* And Law No. (22) of 2007 Concerning the Establishment of Abu Dhabi Future Energy Company (Private Joint Stock Company) and the Establishment of Masdar Institute of Science and Technology.
* And Law No. (8) of 2008 on the Reorganization of the Abu Dhabi Education Council.
And Law No. (6) of 2016 Concerning Human Resources in the Emirate of Abu Dhabi.
* And Federal Law No. (1) of 1972 Concerning the Competencies of Ministries and the Powers of Ministers, and its amending laws.
And Federal Decree-Law No. (1) of 2010 on the Establishment and Regulation of the National Qualifications Authority.
* And based on the proposal submitted to and approved by the Executive Council.
* We have issued the following Law:
Article (1)
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each of them, unless the context otherwise requires:
The State: The United Arab Emirates.
The Emirate: The Emirate of Abu Dhabi.
The Executive Council: The Executive Council of the Emirate.
The Department: The Department of Education and Knowledge.
The Competent Authorities: The Ministry of Education, the National Qualifications Authority, the Department, and any other entity related to higher education and scientific research.
The University: Khalifa University of Science and Technology.
The Board of Trustees: The Board of Trustees of the University.
The President: The President of the University.
Higher Education Programs: Accredited academic programs from bachelor's to doctoral levels and other academic degrees, and continuing education programs approved by the Board of Trustees.
Article (2)
Related Judicial Provisions
* Pursuant to the provisions of this Law, a university named "Khalifa University of Science and Technology" shall be established, which shall have a legal personality and the full legal capacity to act. It shall enjoy financial and administrative independence in all its affairs and shall report to the Executive Council.
* The University shall replace each of Khalifa University of Science, Technology and Research, the Petroleum Institute, and the Masdar Institute of Science and Technology. All rights, obligations, assets, properties, and funds related to these entities shall be transferred to the University.
Article (3)
The main headquarters of the University shall be in the city of Abu Dhabi. By a decision of the Board of Trustees, branches may be opened within or outside the Emirate after the approval of the Executive Council.
Article (4)
The University aims to support the process of development, advancement, and scientific research by offering higher education programs and conducting scientific research to achieve academic and research excellence at the local, regional, and international levels, and to supply the community with qualified personnel, in accordance with applicable legislation. To achieve this, it may undertake the following:
- Strengthening cultural and scientific ties by concluding cooperation and scientific exchange agreements with distinguished academic and scientific institutions inside and outside the State.
- Creating a link between academic thought and community institutions, and creating mutual benefit in this field.
- Encouraging, supporting, and sponsoring scientific research activities and programs for the transfer of knowledge and modern technology.
- Preparing and training scientifically and practically qualified personnel in all aspects of science and knowledge through organizing and implementing advanced educational and training programs with the highest levels of technology and professionalism.
- Conducting academic and applied research in fields of scientific and strategic importance.
- Promoting the culture, applications, and projects of innovation and entrepreneurship.
- Providing consultations, information, and services in all academic, scientific, and administrative fields, and organizing seminars, conferences, and training courses to serve all sectors of the community.
- Any other competencies assigned to it by the Executive Council.
Article (5)
The University shall have a Board of Trustees of no less than five members, including the Chairman of the Board of Trustees and his Deputy. A decision on their appointment and remuneration shall be issued by the Chairman of the Executive Council.
* The term of membership of the Board of Trustees shall be three years, renewable.
Article (6)

* The Board of Trustees shall have the following competencies:
- Approving the general policy and strategic plans of the University, and monitoring their implementation.
- Forming advisory committees for specializations and academic and training curricula.
- Approving specializations, curricula, academic and training programs, study and training plans, and determining their duration in coordination with the competent authorities.
- Granting accredited academic degrees and certificates in accordance with the established regulations, and approving admission policies, study and training systems, examinations, and graduation requirements.
- Approving proposals for linking the University's strategy with economic and industrial institutions.
- Issuing academic and technical regulations and policies.
- Issuing the internal regulations of the University, including financial, administrative, and human resources regulations, after the approval of the Executive Council.
- Issuing its internal bylaws regulating its meetings, convening procedures, and voting on its resolutions.
- Forming committees as needed, and it may delegate any of its powers to such committees.
- Proposing the draft annual budget of the University and submitting it to the Executive Council in accordance with the established systems.
- Determining university fees and financial rewards for students.
- Issuing the organizational structure of the University.
- Establishing the foundations and standards for monitoring the quality of education and applying its highest levels at the University.
- Reviewing periodic reports on the University's performance.
- Approving educational agreements concluded by the University within or outside the Emirate.
- Establishing continuing education centers that are financially and administratively linked to the University.
- Establishing endowment funds for the benefit of the University's objectives and goals.
- Borrowing in accordance with applicable legislation.
- Establishing or contributing to companies related to the University's competencies, and submitting reports on such companies and their performance to the Department.
- Entering into partnerships that fall under the University's jurisdiction.
- Approving the implementation of strategies related to commercial activities and intellectual property arising from the University's research and its collaborations with third parties.
* The Board of Trustees may delegate some of its competencies to the President or to any of its members.
Article (7)
* The University shall have a President whose appointment and allocation shall be determined by a decision of the Chairman of the Executive Council upon the recommendation of the Board of Trustees. He shall manage the daily work of the University, and shall in particular have the following powers:
- Proposing the necessary plans to implement the University's general policy and strategy and submitting them to the Board of Trustees for approval.
- Submitting academic and administrative programs and plans that contribute to achieving the University's objectives to the Board of Trustees.
- Preparing the draft annual budget and final account of the University and submitting them to the Board of Trustees.
- Proposing academic and technical regulations and policies.
- Proposing internal regulations and systems related to financial, administrative, human resources, and the organizational structure of the University and submitting them to the Board of Trustees.
- Preparing periodic reports on the progress of work at the University and submitting them to the Board of Trustees.
- Representing the University before the judiciary or third parties.
- Managing the scientific, financial, and administrative affairs of the University in accordance with the provisions of this Law and the regulations and decisions issued for its implementation.
- Presenting the annual work plan of the University and submitting it to the Board of Trustees.
- Any other competencies assigned to him by the Board of Trustees.
* The President of the University may delegate some of his competencies to senior university staff.
Article (8)
The financial resources of the University shall consist of the following:
- Annual appropriations allocated to it by the Government of Abu Dhabi.
- University fees.
- Proceeds from the investment of its movable and immovable funds.
- Gifts, subsidies, grants, and other revenues that are consistent with the University's objectives and approved by the Board of Trustees.
- Financial support from the public sector or from private sector companies and institutions, individuals, and various scientific research funding institutions, which is allocated to finance specific research or activities and is disbursed according to its designated purposes, outside the approved budget of the University.
Article (9)
The fiscal year of the University shall begin on the first of January and end on the 31st of December of each year, with the exception of the first fiscal year, which shall begin on the date this Law comes into force and end on the last day of December of the following year.
Article (10)
The Board of Trustees shall appoint one or more certified legal auditors to review and audit all the University's accounts. The auditor shall submit an annual report on the results of his work to the Board of Trustees and a copy thereof to the Department.
Article (11)
The academic and administrative staff and employees of Khalifa University of Science, Technology and Research, the Petroleum Institute, and the Masdar Institute of Science and Technology shall be transferred to the University.
Article (12)
Related Judicial Provisions
The current regulations, systems, and contracts of the employees of Khalifa University of Science, Technology and Research, the Petroleum Institute, and the Masdar Institute of Science and Technology who are transferred from each of them shall remain in force until the Board of Trustees approves the human resources regulations, policies, and employment contracts applicable at the University.
Article (13)
Law No. (9) of 2000 and Law No. (3) of 2007 referred to herein are hereby repealed.
* All provisions of Law No. (22) of 2007 referred to herein that pertain to the Masdar Institute of Science and Technology are hereby repealed.
* Any text or provision that contradicts or conflicts with the provisions of this Law shall be repealed.
Article (14)
This Law shall be effective from the date of its issuance and shall be published in the Official Gazette.
